      625 ILCS 5/13-101         from Ch. 95 1/2, par. 13-101
          Amends the Illinois Vehicle Code to provide that any taxi
      cab operating in a municipality with  a  population  of  more
      than  1,000,000 is subject to inspection by the Department of
      Transportation.  Provides that  a  home  rule  unit  may  not
      regulate  taxi  cabs  in  a  manner  inconsistent  with these
      provisions.

 1        AN ACT to amend the Illinois Identification Card  Act  by
 2    changing Section 14A.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The  Illinois  Identification  Card  Act  is
 6    amended by changing Section 14A as follows:
 7        (15 ILCS 335/14A) (from Ch. 124, par. 34A)
 8        Sec.   14A.     Fictitious    or    unlawfully    altered
 9    identification card.
10        (a)  As used in this Section:
11             1.  "A  fictitious  identification  card"  means any
12        issued  identification  card  for  which  a  computerized
13        number and file have been created  by  the  Secretary  of
14        State,  the  United States Government, any other state or
15        political subdivision thereof,  or  any  governmental  or
16        quasi-governmental   organization   that  contains  false
17        information concerning the  identity  of  the  individual
18        issued the identification card;
19             2.  "False   information"   means   any  information
20        concerning the name, sex, date of birth, social  security
21        number  or  any  photograph that falsifies all or in part
22        the  actual  identity  of  the  individual   issued   the
23        identification card;
24             3.  "An   unlawfully  altered  identification  card"
25        means  any  issued  identification  card  for   which   a
26        computerized  number  and  file  have been created by the
27        Secretary of State, the  United  States  Government,  any
28        other  state  or  political  subdivision  thereof, or any
29        governmental or quasi-governmental organization that  has
30        been  physically altered or changed in such a manner that
31        false information appears upon the identification card;

 1             4.  "A  document  capable  of  defrauding   another"
 2        includes,  but  is  not limited to, any document by which
 3        any right, obligation or  power  with  reference  to  any
 4        person  or  property may be created, transferred, altered
 5        or terminated;
 6             5.  An "identification document" or  "identification
 7        card"  means  any document made or issued by or under the
 8        authority of the United States Government, the  State  of
 9        Illinois  or  any  other  state  or political subdivision
10        thereof, or any other governmental or  quasi-governmental
11        organization   which,  when  completed  with  information
12        concerning the individual,  is  of  a  type  intended  or
13        commonly accepted for the purpose of identification of an
14        individual.
15        (b)  It is a violation of this Section for any person:
16             1.  To  knowingly  possess,  display, or cause to be
17        displayed   any   fictitious   or   unlawfully    altered
18        identification card;
19             2.  To  knowingly  possess,  display, or cause to be
20        displayed   any   fictitious   or   unlawfully    altered
21        identification  card  for  the  purpose  of obtaining any
22        account, credit, credit card or debit card from  a  bank,
23        financial institution or retail mercantile establishment;
24             3.  To   knowingly   possess   any   fictitious   or
25        unlawfully altered identification card with the intent to
26        commit  a  theft, deception or credit or debit card fraud
27        in violation of any law of this State or any law  of  any
28        other jurisdiction;
29             4.  To   knowingly   possess   any   fictitious   or
30        unlawfully altered identification card with the intent to
31        commit  any  other  violation of any law of this State or
32        any law of any other jurisdiction for which a sentence to
33        a term of imprisonment in a penitentiary for one year  or
34        more is provided;

 1             5.  To   knowingly   possess   any   fictitious   or
 2        unlawfully   altered   identification   card   while   in
 3        unauthorized  possession  of  any document, instrument or
 4        device capable of defrauding another;
 5             6.  To   knowingly   possess   any   fictitious   or
 6        unlawfully altered identification card with the intent to
 7        use  the  identification  card  to  acquire   any   other
 8        identification document;
 9             7.  To  knowingly issue or assist in the issuance of
10        any fictitious identification card;
11             8.  To knowingly  alter  or  attempt  to  alter  any
12        identification card;
13             9.  To  knowingly manufacture, possess, transfer, or
14        provide  any  identification  document  whether  real  or
15        fictitious for the  purpose  of  obtaining  a  fictitious
16        identification card;
17             10.  To   make   application   for  the  purpose  of
18        obtaining a fictitious identification  card  for  another
19        person;
20             11.  To  obtain  the  services  of another person to
21        make  application  for  the  purpose   of   obtaining   a
22        fictitious identification card.
23        (c)  Sentence.
24             1.  Any person convicted of a violation of paragraph
25        1,  10,  or 11 of subsection (b) of this Section shall be
26        guilty of a  Class  4  felony  A  misdemeanor.  A  person
27        convicted  of  a  second or subsequent violation shall be
28        guilty of a Class 3 4 felony and shall be sentenced to  a
29        minimum  fine  of  $500 or 50 hours of community service,
30        preferably at an alcohol  abuse  prevention  program,  if
31        available.
32             2.  Any person convicted of a violation of paragraph
33        1  of  subsection  (b) of this Section who at the time of
34        arrest had in his possession two or  more  fictitious  or

 1        unlawfully  altered  identification cards shall be guilty
 2        of a Class 4 felony.
 3             3.  Any person convicted of a violation of paragraph
 4        2 through 9 of subsection (b) of this  Section  shall  be
 5        guilty  of  a  Class  4  felony.  A person convicted of a
 6        second or subsequent violation shall be guilty of a Class
 7        3 felony.
 8        (d)  This  Section  does  not   prohibit   any   lawfully
 9    authorized  investigative,  protective,  law  enforcement  or
10    other  activity  of any agency of the United States, State of
11    Illinois or any other state or political subdivision thereof.
