90_SB0422 15 ILCS 20/38.3 Amends the Civil Administrative Code of Illinois. Adds to the Responsible Education Funding Law in the Code a provision that requires the aggregate supplemental appropriations made from the General Revenue Fund for elementary and secondary education for a fiscal year to bear to the aggregate supplemental appropriations made from the General Revenue Fund for all purposes for that fiscal year a ratio that is not less than the ratio which the aggregate non-supplemental General Revenue Fund appropriations for elementary and secondary education for the fiscal year bear to the aggregate non-supplemental General Revenue Fund appropriations for all purposes for that fiscal year. Defines supplemental appropriations. Effective immediately. LRB9002839THpk LRB9002839THpk 1 AN ACT to amend the Civil Administrative Code of Illinois 2 by changing Section 38.3. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Civil Administrative Code of Illinois is 6 amended by changing Section 38.3 as follows: 7 (15 ILCS 20/38.3) 8 Sec. 38.3. Responsible Education Funding Law. 9 (a) The Governor shall submit to the General Assembly a 10 proposed budget for elementary and secondary education in 11 which total General Revenue Fund appropriations are no less 12 than the total General Revenue Fund appropriations of the 13 previous fiscal year. In addition, the Governor shall 14 specify the total amount of funds to be transferred from the 15 General Revenue Fund to the Common School Fund during the 16 budget year, which shall be no less than the total amount 17 transferred during the previous fiscal year. The Governor 18 may submit a proposed budget in which the total appropriated 19 and transferred amounts are less than the previous fiscal 20 year if the Governor declares in writing to the General 21 Assembly the reason for the lesser amounts. 22 (b) The General Assembly shall appropriate amounts for 23 elementary and secondary education from the General Revenue 24 Fund for each fiscal year so that the total General Revenue 25 Fund appropriation is no less than the total General Revenue 26 Fund appropriation for elementary and secondary education for 27 the previous fiscal year. In addition, the General Assembly 28 shall legislatively transfer from the General Revenue Fund to 29 the Common School Fund for such fiscal year a total amount 30 that is no less than the total amount transferred for the 31 previous fiscal year. The General Assembly may appropriate -2- LRB9002839THpk 1 or transfer lesser amounts if it declares by Joint Resolution 2 the reason for the lesser amounts. 3 (c) Beginning with fiscal year 1998 and in each fiscal 4 year thereafter, the aggregate amount of supplemental 5 appropriations made from the General Revenue Fund by the 6 General Assembly for elementary and secondary education for 7 the fiscal year shall be an amount that is not less than the 8 product of the aggregate amount of supplemental 9 appropriations made from the General Revenue Fund by the 10 General Assembly for all purposes for that fiscal year 11 multiplied by a fraction, the numerator of which is the 12 aggregate amount appropriated from the General Revenue Fund 13 for elementary and secondary education for that fiscal year 14 (exclusive of the amount of any supplemental General Revenue 15 Fund appropriations made for elementary and secondary 16 education for that fiscal year) and the denominator of which 17 is the aggregate amount appropriated from the General Revenue 18 Fund for all purposes for that fiscal year (exclusive of the 19 amount of any supplemental General Revenue Fund 20 appropriations made for any purpose for that fiscal year). 21 As used in this subsection, "supplemental appropriations" 22 means amounts appropriated from the General Revenue Fund 23 under legislation that is introduced, amended, or made part 24 of a conference committee report and enacted on or after July 25 1 of a fiscal year and that increase the amount appropriated 26 from the General Revenue Fund for that same fiscal year. 27 (d) This Section may be cited as the Responsible 28 Education Funding Law. 29 (Source: P.A. 88-660, eff. 9-16-94.) 30 Section 99.
