Requires health care professionals who have direct or supervisory responsibility for administering immunizations to register with the Department their intent to administer immunizations to persons under age 22 and to report the administration of such immunizations; makes failure to register or report a petty offense punishable by a fine of $25. LRB9002077DJcd LRB9002077DJcd 1 AN ACT to amend the Communicable Disease Prevention Act 2 by adding Sections 4 and 5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Communicable Disease Prevention Act is 6 amended by adding Sections 4 and 5 as follows: 7 (410 ILCS 315/4 new) 8 Sec. 4. Statewide childhood immunization registry. 9 (a) The Department of Public Health shall establish a 10 statewide childhood immunization registry. Immunization 11 records contained in the registry shall include the data 12 specified by the Department. 13 (b) The Department of Public Health shall make 14 information in the registry concerning the immunization 15 status of a child available to the parents or other legal 16 custodian of the child. The Department shall also make the 17 information available to health care professionals who have 18 direct or supervisory responsibility for the administration 19 of immunizations and who either report under Section 5 on the 20 immunization status of children in their care or need that 21 information in order to deliver appropriate care to a child. 22 (c) The Department of Public Health shall adopt rules 23 necessary to implement this Section. The rules shall include 24 provisions for maintaining the confidentiality of medical 25 information. 26 (410 ILCS 315/5 new) 27 Sec. 5. Registration and reports by health care 28 providers; penalty. 29 (a) In this Section, "provider" means a health care 30 professional who has direct or supervisory responsibility for -2- LRB9002077DJcd 1 the administration of immunizations. 2 (b) Every provider shall register with the Department of 3 Public Health the provider's intent to administer childhood 4 immunizations to persons under 22 years of age. The 5 registration shall be done according to guidelines 6 established by the Department in rules. 7 (c) Every provider shall report to the Department of 8 Public Health the administration of any childhood 9 immunization to a person under 22 years of age. 10 (d) A provider who administers a childhood immunization 11 to a person under 22 years of age and who (i) fails to 12 register with the Department of Public Health as required 13 under subsection (b), (ii) fails to report the immunization 14 as required under subsection (c), or (iii) both fails to 15 register with the Department as required under subsection (b) 16 and fails to report the immunization as required under 17 subsection (c) commits a petty offense and upon conviction of 18 the offense shall be fined $25. 19 (e) The Department of Public Health shall adopt rules 20 necessary to implement this Section.
