LRB9002552SMcw SB327 Enrolled LRB9002552SMcw 1 AN ACT to amend the Alzheimer's Disease Assistance Act by 2 changing Sections 3, 4, and 7. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Alzheimer's Disease Assistance Act is 6 amended by changing Sections 3, 4, and 7 as follows: 7 (410 ILCS 405/3) (from Ch. 111 1/2, par. 6953) 8 Sec. 3. Definitions. As used in this Act: 9 (a) "Alzheimer's disease and related disorders" means a 10 health condition resulting from significant destruction of 11 brain tissue with resultant loss of brain function, 12 including, but not limited to, progressive, degenerative and 13 dementing illnesses including presenile and senile dementias, 14 including Alzheimer's disease and other related disorders. 15 (b) "Regional Alzheimer's Disease Assistance Center" or 16 "Regional ADA Center" means anyapostsecondary higher 17 educational institution having a medical school in 18 affiliation with a medical center and having a National 19 Institutes of Health and National Institutes on Aging 20 sponsored Alzheimer's Disease Core Center, and designated as21such by the Illinois Department of Public Health under22Section 4 of this Act. Any Regional ADA Center which was 23 designated as having a National Alzheimer's Disease Core 24 Center but no longer carries such designation shall continue 25 to serve as a Regional ADA Center. 26 (c) "Primary Alzheimer's provider" means a licensed 27 hospital, a medical center under the supervision of a 28 physician licensed to practice medicine in all of its 29 branches, or a medical center that provides medical 30 consultation, evaluation, referral and treatment to persons 31 who may be or who have been diagnosed as victims of SB327 Enrolled -2- LRB9002552SMcw 1 Alzheimer's disease or related disorders pursuant to 2 policies, standards, criteria and procedures adopted under an 3 affiliation agreement with a Regional ADA Center under this 4 Act. 5 (d) "Alzheimer's disease assistance network" or "ADA 6 network" means the various health, mental health and social 7 services agencies that provide referral, treatment and 8 support services under standards and plans adopted and 9 implemented in conjunction with a Regional ADA Center. 10 (e) "ADA Advisory Committee" or "Advisory Committee" or 11 "Committee" means the Alzheimer's Disease Advisory Committee 12 created under Section 6 of this Act. 13 (f) "Department" means the Illinois Department of Public 14 Health. 15 (Source: P.A. 84-378; 84-513.) 16 (410 ILCS 405/4) (from Ch. 111 1/2, par. 6954) 17 Sec. 4. Development of standards for a service network 18 and designation of regional centers and primary providers. 19 By January 1, 1987, the Department, in consultation with the 20 Advisory Committee, shall develop standards for the conduct 21 of research and for the identification, evaluation, 22 diagnosis, referral and treatment of victims of Alzheimer's 23 disease and related disorders and their families through the 24 ADA network of designated regional centers and other 25 providers of service under this Act. Such standards shall 26 include: 27 (a) A description of the specific populations and 28 geographic areas to be served through ADA networks that may 29 be established under this Act; 30 (b) Standards, criteria and procedures for designation 31 of Regional ADA Centers, which ensure the provision of 32 quality care to a broad segment of the population through 33 on-site facilities and services and through a network of SB327 Enrolled -3- LRB9002552SMcw 1 primary Alzheimer's providers and other providers of service 2 that may be available within the service area defined by the 3 Department. At least 2oneRegional ADA CentersCentershall 4 be conveniently located to serve the Chicago metropolitan 5 area and at least one Regional ADA Center shall be 6 conveniently located to serve the balance of the State. The 7 Regional ADA Centers shall provide at least the following: 8 (1) Comprehensive diagnosis and treatment facilities and 9 services which have (i) professional medical staff 10 specially-trained in geriatric medicine, neurology, 11 psychiatry and pharmacology, and the detection, diagnosis and 12 treatment of Alzheimer's disease and related disorders, (ii) 13 sufficient support staff who are trained as caregivers to 14 victims of Alzheimer's disease and related disorders, (iii) 15 appropriate and adequate equipment necessary for diagnosis 16 and treatment, (iv) transportation services necessary for 17 outreach to the service area defined by the Department and 18 for assuring access of patients to available services, (v) 19 and such other support services, staff and equipment as may 20 be required; 21 (2) Consultation and referral services for victims and 22 their families to ensure informed consent to treatment and to 23 assist them in obtaining necessary assistance and support 24 services through primary Alzheimer's providers and various 25 private and public agencies that may otherwise be available 26 to provide services under this Act; 27 (3) Research programs and facilities to assist faculty 28 and students in discovering the cause of and the diagnosis, 29 cure and treatment for Alzheimer's disease and related 30 disorders; 31 (4) Training, consultation and continuing education for 32 caregivers, including families of those who are affected by 33 Alzheimer's disease and related disorders; 34 (5) Centralized data collection, processing and storage SB327 Enrolled -4- LRB9002552SMcw 1 that will serve as a clearinghouse of information to assist 2 victims, families and ADA Resources, and to facilitate 3 research; and 4 (6) Programs of scientific and medical research in 5 relation to Alzheimer's disease and related disorders that 6 are designed and conducted in a manner that may enable such 7 center to qualify for Federal financial participation in the 8 cost of such programs. 9 (c) Procedures for recording and reporting research and 10 treatment results by primary Alzheimer's providers and other 11 affiliated providers of service that are within the ADA 12 network to the Regional ADA Center and to the Department; 13 (d) Policies, procedures and minimum standards and 14 criteria to be included in affiliation agreements between 15 primary Alzheimer's providers and the Regional ADA Center in 16 the conduct of any research and in the diagnosis, referral 17 and treatment of victims of Alzheimer's disease and related 18 disorders and their families; and 19 (e) Policies, procedures, standards and criteria, 20 including medical and financial eligibility factors, 21 governing admission to and utilization of the programs, 22 facilities and services available through the ADA network by 23 persons who may be or who have been diagnosed as victims of 24 Alzheimer's disease and related disorders, including forms 25 and procedures for obtaining necessary patient consents to 26 participation in research, and in the reporting and 27 processing of appropriate information in a patient's medical 28 records in relation to consultations, referrals and 29 treatments by the various providers of service within the ADA 30 network. 31 (Source: P.A. 84-378; 84-513.) 32 (410 ILCS 405/7) (from Ch. 111 1/2, par. 6957) 33 Sec. 7. Regional ADA center grants-in-aid. Pursuant to SB327 Enrolled -5- LRB9002552SMcw 1 appropriations enacted by the General Assembly, the 2 Department shall provide grants-in-aid to each Regional ADA 3 CenterCentersfor necessary research and for the development 4 and maintenance of services for victims of Alzheimer's 5 disease and related disorders and families in accordance with 6 the State Alzheimer's Assistance Plan. The first $2,000,000 7 of any grants-in-aid appropriated by the General Assembly for 8 Regional ADA Centers in any State fiscal year shall be 9 distributed in equal portions to those Regional ADA Centers 10 receiving the appropriated grants-in-aid for the State fiscal 11 year beginning July 1, 1996. The first $400,000 appropriated 12 by the General Assembly in excess of $2,000,000 in any State 13 fiscal year beginning on or after July 1, 1997 shall be 14 distributed in equal portions to those Regional ADA Centers 15 receiving the appropriated grants-in-aid for the State fiscal 16 year beginning July 1, 1996. Any monies appropriated by the 17 General Assembly in excess of $2,400,000 for any State fiscal 18 year beginning on or after July 1, 1997 shall be distributed 19 in equal portions to each Regional ADA Center. The Department 20 shall promulgate rules and procedures governing the 21 distribution and specific purposes for such grants, including 22 any contributions of recipients of services toward the cost 23 of care. 24 (Source: P.A. 84-378; 84-513.) 25 Section 99. Effective date. This Act takes effect upon 26 becoming law.
