          Amends the Illinois Pull Tabs and Jar Games  Act.  Raises
      the  maximum allowable single prize limit from $250 to $1000.
      Removes the limits on the allowable number of  tickets  in  a
      game.   Removes  the  limits  on  the  aggregate value of all
      prizes or merchandise that can be awarded in a single day  of
      pull tabs and jar games.

 1        AN  ACT to amend the Illinois Pull Tabs and Jar Games Act
 2    by changing Sections 1.1 and 4.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The Illinois Pull Tabs and Jar Games Act is
 6    amended by changing 1.1 and 4 as follows:
 7        (230 ILCS 20/1.1) (from Ch. 120, par. 1051.1)
 8        Sec. 1.1.  Definitions.  As used in this Act:
 9        "Pull  tabs"  and  "jar  games"  means   a   game   using
10    single-folded  or banded tickets or a card, the face of which
11    is initially covered or otherwise hidden from view  in  order
12    to  conceal a number, symbol or set of symbols, some of which
13    are winners.  Players with winning tickets  receive  a  prize
14    stated  on  a promotional display or "flare".  Pull tabs also
15    means a game in which prizes are won by pulling a tab from  a
16    board  thereby  revealing  a  number which corresponds to the
17    number for a given prize.
18        Each winning pull tab or slip shall be predetermined.  In
19    no instance shall the right to participate in such games cost
20    more than one dollar, nor shall any single prize exceed $1000
21    $250.  There shall be no more than  4000 tickets in a game.
22        "Pull tabs and jar games", as used in this Act, does  not
23    include  the  following:  numbers,  policy, bolita or similar
24    games, dice, slot machines,  bookmaking  and  wagering  pools
25    with respect to a sporting event, or that game commonly known
26    as  punch boards, or any other game or activity not expressly
27    defined in this Section.
28        "Organization" means a corporation, agency,  partnership,
29    association,  firm  or  other  entity consisting of 2 or more
30    persons joined by a common interest or purpose.
31        "Non-profit  organization"  means  an   organization   or

 1    institution organized and conducted on a not-for-profit basis
 2    with  no personal profit inuring to anyone as a result of the
 3    operation.
 4        "Charitable  organization"  means  an   organization   or
 5    institution  organized  and operated to benefit an indefinite
 6    number of the public.
 7        "Educational  organization"  means  an  organization   or
 8    institution  organized  and  operated  to  provide systematic
 9    instruction in useful branches of learning by methods  common
10    to   schools  and  institutions  of  learning  which  compare
11    favorably in their scope and intensity  with  the  course  of
12    study presented in tax-supported schools.
13        "Religious  organization" means any church, congregation,
14    society, or organization founded for the purpose of religious
15    worship.
16        "Fraternal  organization"  means   an   organization   of
17    persons,  including  but not limited to ethnic organizations,
18    having a common interest, organized and operated  exclusively
19    to  promote  the  welfare  of  its members and to benefit the
20    general public on a continuing and consistent basis.
21        "Veterans' organization" means an organization  comprised
22    of members of which substantially all are individuals who are
23    veterans  or  spouses,  widows,  or widowers of veterans, the
24    primary purpose of which is to promote  the  welfare  of  its
25    members  and  to  provide assistance to the general public in
26    such a way as to confer a public benefit.
27        "Labor organization" means an  organization  composed  of
28    labor  unions  or  workers  organized  with  the objective of
29    betterment of the conditions of those engaged in such pursuit
30    and the development of a higher degree of efficiency in their
31    respective occupations.
32        "Youth  athletic  organization"  means  an   organization
33    having  as  its exclusive purpose the promotion and provision
34    of athletic activities for youth aged 18 and under.

 1        "Senior citizens organization" means an  organization  or
 2    association  comprised  of members of which substantially all
 3    are individuals who are senior citizens, as  defined  in  the
 4    Illinois Act on the Aging, the primary purpose of which is to
 5    promote the welfare of its members.

 8        Sec.  4.   The  conducting  of pull tabs and jar games is
 9    subject to the following restrictions:
10        (1)  The entire net proceeds of  any  pull  tabs  or  jar
11    games,  except  as  otherwise  approved  in this Act, must be
12    exclusively  devoted  to   the   lawful   purposes   of   the
13    organization permitted to conduct such drawings.
14        (2)  No  person  except a bona fide member or employee of
15    the sponsoring organization may participate in the management
16    or operation of such pull tabs or jar games; however, nothing
17    herein shall conflict with pull tabs and jar games  conducted
18    under the provisions of the Charitable Games Act.
19        (3)  No person may receive any remuneration or profit for
20    participating  in  the  management  or operation of such pull
21    tabs or jar games; however,  nothing  herein  shall  conflict
22    with  pull  tabs and jar games conducted under the provisions
23    of the Charitable Games Act.
24        (4)  The price paid for  a  single  chance  or  right  to
25    participate  in  a  game  licensed  under  this Act shall not
26    exceed $1. The aggregate value of all prizes  or  merchandise
27    awarded  in  any  single day of pull tabs and jar games shall
28    not exceed $2,250, except that in adjoining  counties  having
29    200,000  to  275,000  inhabitants each, and in counties which
30    are adjacent to either of such  adjoining  counties  and  are
31    adjacent  to total of not more than 2 counties in this State,
32    the value of all prizes or merchandise awarded may not exceed
33    $3,250 in a single day.

 1        (5)  No person under the age of 18 years  shall  play  or
 2    participate  in games under this Act.  A person under the age
 3    of 18 years may be within the area where pull  tabs  and  jar
 4    games are being conducted only when accompanied by his parent
 5    or guardian.
 6        (6)  Pull  tabs  and jar games shall be conducted only on
 7    premises owned or occupied by licensed organizations and used
 8    by its members for general activities, or on  premises  owned
 9    or  rented  for conducting the game of bingo, or as permitted
10    in subsection (4) of Section 3.
