          Amends the Election Code.  Makes a stylistic change.

 1        AN ACT to amend the Election  Code  by  changing  Section
 2    23-24.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Election  Code  is  amended  by  changing
 6    Section 23-24 as follows:
 7        (10 ILCS 5/23-24) (from Ch. 46, par. 23-24)
 8        Sec.  23-24.  Contests  of  constitutional amendments and
 9    public  questions.    In  the  case  of  all   constitutional
10    amendments  or  other questions of public policy submitted to
11    the voters of this State, and  of  all  questions  of  public
12    policy  submitted  to the voters of any political subdivision
13    or district, any 5 electors of the State, or of the political
14    subdivision  or  district,  respectively,  may  contest   the
15    results of any such election by filing a written statement in
16    the  circuit  court  within  30  days after the result of the
17    election shall have been determined, in like form as in other
18    cases of contested  elections  in  the  circuit  court.  Such
19    political  subdivision  shall  be  made defendant and process
20    shall  be  served  as  in  suits   against   such   political
21    subdivision;  and  like  proceedings shall be had as in other
22    cases of contested elections  before  such  court.  Any  such
23    contested election shall be heard and determined by the court
24    in  accordance  with  the provisions of Section 23-23.  Where
25    the contest relates to a constitutional  amendment  or  other
26    question  of  public  policy  submitted  to the voters of the
27    State,  the  statement  of  contest  shall  not  specify  any
28    defendant, but notice  of  the  contest  be  filed  with  the
29    Attorney  General  who  may  appear and take such steps as he
30    shall deem proper with respect to such contest;  the  contest
31    may be heard and determined at any time not less than 10 days

 1    after  notice to the Attorney General as herein provided, and
 2    like proceedings as nearly as may be shall be had as in other
 3    cases of contested elections before such court.
