The Unified Code of Corrections is amended by 6 changing Section 5-5-2 as follows: 7 (730 ILCS 5/5-5-2) (from Ch. 38, par. 1005-5-2) 8 Sec. 5-5-2. Unclassified Offenses.) (a) The particular 9 classification of each felony is specified in the law 10 defining the felony. Any unclassified offense which is 11 declared by law to be a felony or which provides a sentence 12 to a term of imprisonment for one year or more isshall bea 13 Class 4 felony. 14 (b) The particular classification of each misdemeanor is 15 specified in the law or ordinance defining the misdemeanor. 16 (1) Any offense not so classified which provides a 17 sentence to a term of imprisonment of less than one year but 18 in excess of 6 months isshall bea Class A misdemeanor. 19 (2) Any offense not so classified which provides a 20 sentence to a term of imprisonment of 6 months or less but in 21 excess of 30 days isshall bea Class B misdemeanor. 22 (3) Any offense not so classified which provides a 23 sentence to a term of imprisonment of 30 days or less is 24shall bea Class C misdemeanor. 25 (c) Any unclassified offense which does not provide for 26 a sentence of imprisonment isshall bea petty offense or a 27 business offense. 28 (Source: P.A. 80-1099.)
