90_SB0066 105 ILCS 5/9-11.2 from Ch. 122, par. 9-11.2 Amends the School Code. Provides that in school districts that elect its board members according to area of residence and that have one or more unexpired board terms to be filled at an election, the winner or winners of the unexpired term or terms shall be determined independently of those running for full terms. SRS90S0006KSch SRS90S0006KSch 1 AN ACT to amend the School Code by amending Section 2 9-11.2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 1. The School Code is amended by changing 6 Section 9-11.2 as follows: 7 (105 ILCS 5/9-11.2) (from Ch. 122, par. 9-11.2) 8 Sec. 9-11.2. For all school districts electing 9 candidates to a board of education in a manner other than at 10 large, candidates who file nominating petitions for a full 11 term shall be grouped together by area of residence as 12 follows: 13 (1) by congressional townships, or 14 (2) according to incorporated or unincorporated areas. 15 For all school districts electing candidates to a board 16 of education in a manner other than at large, candidates who 17 file nominating petitions for an unexpired term shall be 18 grouped together by area of residence as follows: 19 (1) by congressional townships, or 20 (2) according to incorporated or unincorporated areas. 21 Candidate groupings by area of residence for full terms 22 shall precede the candidate groupings by area of residence 23 for unexpired terms on the ballot. The ballot order of each 24 candidate grouping shall be determined by the order of 25 petition filing or lottery held pursuant to Section 9-11.1 in 26 the following manner: 27 The area of residence of the candidate determined to be 28 first by order of petition filing or by lottery shall be 29 listed first among the candidate groupings on the ballot. 30 All other candidates from the same area of residence will 31 follow according to order of petition filing or the lottery. -2- SRS90S0006KSch 1 The area of residence of the candidate determined to be 2 second by the order of petition filing or the lottery shall 3 be listed second among the candidate groupings on the ballot. 4 All other candidates from the same area of residence will 5 follow according to the order of petition filing or the 6 lottery. The ballot order of additional candidate groupings 7 by area of residence shall be established in a like manner. 8 In any school district that elects its board members 9 according to area of residence and that has one or more 10 unexpired terms to be filled at an election, the winner or 11 winners of the unexpired term or terms shall be determined 12 first and independently of those running for full terms. The 13 winners of the full terms shall then be determined taking 14 into consideration the areas of residence of those elected to 15 fill the unexpired term or terms. 16 "Area of Residence" means congressional township, 17 incorporated and unincorporated territories. 18 (Source: P.A. 84-1338.)
