Amends the Environmental Protection Act to make a
technical change. Effective immediately.

1 AN ACT to amend the Environmental Protection Act by
2 changing Section 22.26.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Environmental Protection Act is amended by
6 changing Section 22.26 as follows:
7 (415 ILCS 5/22.26) (from Ch. 111 1/2, par. 1022.26)
8 Sec. 22.26. Composting facility; permit requirements. The
9 Agency shall not issue a development or construction permit
10 after December 31, 1990 for any composting facility, unless
11 the applicant has given notice thereof (1) in person or by
12 mail to the members of the General Assembly from the
13 legislative district in which the proposed facility is to be
14 located, (2) by registered or certified mail to the owners of
15 all real property located within 250 feet of the site of the
16 proposed facility (determined as provided in subsection (b)
17 of Section 39.2), and (3) to the general public by
18 publication in a newspaper of general circulation in the
19 county in which the proposed facility is to be located.

21 Section 99. Effective date. This Act takes effect upon
22 becoming law.
