90_HB3891 730 ILCS 5/3-6-7 new Amends the Unified Code of Corrections. Provides that when a pregnant female committed person brought to a hospital from an Illinois correctional center for the purpose of delivering her baby, no handcuffs, shackles, or restraints of any kind shall be used during her transport to a medical facility for the purpose of delivering her baby. Prohibits irons or shackles or waist shackles from being used on a pregnant female committed person who is in labor. Requires a correctional officer to be posted immediately outside the delivery room upon the pregnant female committed person's entry to that room. Requires the Department of Corrections to provide for adequate personnel to monitor the pregnant female committed person during her transport to and from the hospital and during her stay at the hospital. The Unified Code of Corrections is amended by 6 adding Section 3-6-7 as follows: 7 (730 ILCS 5/3-6-7 new) 8 Sec. 3-6-7. Pregnant female committed persons. 9 Notwithstanding any other statute, directive or 10 administrative regulation, when a pregnant female committed 11 person is brought to a hospital from an Illinois correctional 12 center for the purpose of delivering her baby, no handcuffs, 13 shackles, or restraints of any kind shall be used during her 14 transport to a medical facility for the purpose of delivering 15 her baby. Under no circumstances shall leg irons or shackles 16 or waist shackles be used on any pregnant female committed 17 person who is in labor. Upon the pregnant female committed 18 person's entry to the hospital delivery room, a correctional 19 officer must be posted immediately outside the delivery room. 20 The Department must provide for adequate personnel to monitor 21 the pregnant female committed person during her transport to 22 and from the hospital and during her stay at the hospital.
