Provides that pension payments shall no longer be suspended while the recipient is employed in a teaching capacity by a public school or charter school located in this State but outside the City of Chicago. Reinstates pensions that are currently suspended for this reason. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately. LRB9008889EGfg LRB9008889EGfg 1 AN ACT to amend the Illinois Pension Code by changing 2 Section 17-150 and to amend the State Mandates Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pension Code is amended by 6 changing Section 17-150 as follows: 7 (40 ILCS 5/17-150) (from Ch. 108 1/2, par. 17-150) 8 Sec. 17-150. Suspension of pensions. Until July 1, 9 1998, pension payments, exclusive of those made to the 10 survivors of persons who were contributors, shall be 11 suspended while the recipient is employed in a teaching 12 capacity, outside the City in which the Fund exists, by any 13 public school or charter school in this State, unless the 14 recipient is so employed temporarily as a substitute teacher 15 for 100 days or less in a school year or on an hourly basis 16 with earnings not in excess of the sum payable for 100 days' 17 substitute service. 18 Beginning July 1, 1998, pension payments shall no longer 19 be suspended while the recipient is employed in a teaching 20 capacity, outside the City in which the Fund exists, by any 21 public school or charter school in this State, and any 22 pension that is in a state of suspension under this Section 23 on July 1, 1998 shall be reinstated on that date. 24 Notwithstanding Section 17-157, the change to this Section 25 made by this amendatory Act of 1998 applies without regard to 26 whether or not the pensioner was in service on or after the 27 effective date of this amendatory Act. 28 (Source: P.A. 90-566, eff. 1-2-98.) 29 Section 90. The State Mandates Act is amended by adding 30 Section 8.22 as follows: -2- LRB9008889EGfg 1 (30 ILCS 805/8.22 new) 2 Sec. 8.22. Exempt mandate. Notwithstanding Sections 6 3 and 8 of this Act, no reimbursement by the State is required 4 for the implementation of any mandate created by this 5 amendatory Act of 1998. 6 Section 99. Effective date. This Act takes effect upon 7 becoming law.
