LRB9011162EGfg LRB9011162EGfg 1 AN ACT to amend the Illinois Pension Code by changing 2 Section 9-179.2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pension Code is amended by 6 changing Section 9-179.2 as follows: 7 (40 ILCS 5/9-179.2) (from Ch. 108 1/2, par. 9-179.2) 8 Sec. 9-179.2. Other governmental service-Former County 9 Service. Any employee who has rendered service to any 10 "governmental unit" as such term is defined in the 11 "Retirement Systems Reciprocal Act" under Article 20 of the 12 Illinois Pension Code, who did not contribute to the 13 retirement system of such "governmental unit", including the 14 retirement system created by this Article 9 of the Illinois 15 Pension code, for such service because of ineligibility for 16 participation and has no equity or rights in such retirement 17 system because of such service shall be given credit for such 18 service in this fund, provided: 19 (a) The employee shall pay to this fund, while in the 20 service of such county, or while in the service of a 21 governmental unit whose retirement system has adopted the 22 "Retirement Systems Reciprocal Act", such amounts, including 23 interest at the effective rate, as he would have paid to this 24 fund, on the basis of his salary in effect during the service 25 rendered to such other "governmental unit" at the rates 26 prescribed inSection 9 ofthis Article 9 for the periods of 27 such service to the end that such service shall be considered 28 as service rendered to such county, with all the rights and 29 conditions attaching to such service and payments; and (b) 30 this Section shall not be applicable to any period of such 31 service for which the employee retains credit in any other -2- LRB9011162EGfg 1 public annuity and benefit fund established by Act of the 2 Legislature of this State and in operation for employees of 3 such other "governmental unit" from which such employee was 4 transferred. 5 (Source: P.A. 77-1220; revised 12-18-97.) 6 Section 99. Effective date. This Act takes effect upon 7 becoming law.
