The Criminal Code of 1961 is amended by 6 changing Section 20-1 as follows: 7 (720 ILCS 5/20-1) (from Ch. 38, par. 20-1) 8 Sec. 20-1. Arson. 9 A person commits arson when, by means of fire or 10 explosive, he knowingly: 11 (a) Damages any real property, or any personal property 12 having a value of $150 or more, of another without his 13 consent; or 14 (b) With intent to defraud an insurer, damages any 15 property or any personal property having a value of $150 or 16 more. 17 Property "of another" means a building or other property, 18 whether real or personal, in which a person other than the 19 offender has an interest which the offender has no authority 20 to defeat or impair, even though the offender may also have 21 an interest in the building or property. 22 (c) Sentence. 23 Arson is a Class 2 felony. Arson is a Class 1 felony 24 when the property damaged is a dwelling. 25 (Source: P.A. 77-2638.)
