Prohibits the imposition of interest charges as long as the consumer is making regular payments of more than $50 per month toward the unpaid balance. LRB9010064JSgc LRB9010064JSgc 1 AN ACT concerning charges imposed by health care 2 providers, amending named Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Alternative Health Care Delivery Act is 6 amended by adding Section 47 as follows: 7 (210 ILCS 3/47 new) 8 Sec. 47. Interest charges limited. A licensee or person 9 authorized to provide health care services under this Act may 10 not impose interest charges with respect to the unpaid 11 balance of a consumer's bill as long as the consumer is 12 making regular payments of more than $50 per month on the 13 unpaid balance. 14 Section 10. The Ambulatory Surgical Treatment Center Act 15 is amended by adding Section 12.5 as follows: 16 (210 ILCS 5/12.5 new) 17 Sec. 12.5. Interest charges limited. A licensee or 18 person authorized to provide health care services under this 19 Act may not impose interest charges with respect to the 20 unpaid balance of a consumer's bill as long as the consumer 21 is making regular payments of more than $50 per month on the 22 unpaid balance. 23 Section 15. The Community Living Facilities Licensing 24 Act is amended by adding Section 5.5 as follows: 25 (210 ILCS 35/5.5 new) 26 Sec. 5.5. Interest charges limited. A licensee or person 27 authorized to provide health care services under this Act may -2- LRB9010064JSgc 1 not impose interest charges with respect to the unpaid 2 balance of a consumer's bill as long as the consumer is 3 making regular payments of more than $50 per month on the 4 unpaid balance. 5 Section 20. The Life Care Facilities Act is amended by 6 adding Section 5.5 as follows: 7 (210 ILCS 40/5.5 new) 8 Sec. 5.5. Interest charges limited. A licensee or person 9 authorized to provide health care services under this Act may 10 not impose interest charges with respect to the unpaid 11 balance of a consumer's bill as long as the consumer is 12 making regular payments of more than $50 per month on the 13 unpaid balance. 14 Section 25. The Nursing Home Care Act is amended by 15 adding Section 3-407.5 as follows: 16 (210 ILCS 45/3-407.5 new) 17 Sec. 3-407.5. Interest charges limited. A licensee or 18 person authorized to provide health care services under this 19 Act may not impose interest charges with respect to the 20 unpaid balance of a consumer's bill as long as the consumer 21 is making regular payments of more than $50 per month on the 22 unpaid balance. 23 Section 30. The Home Health Agency Licensing Act is 24 amended by adding Section 6.5 as follows: 25 (210 ILCS 55/6.5 new) 26 Sec. 6.5. Interest charges limited. A licensee or person 27 authorized to provide health care services under this Act may 28 not impose interest charges with respect to the unpaid -3- LRB9010064JSgc 1 balance of a consumer's bill as long as the consumer is 2 making regular payments of more than $50 per month on the 3 unpaid balance. 4 Section 35. The Hospice Program Licensing Act is amended 5 by adding Section 9.5 as follows: 6 (210 ILCS 60/9.5 new) 7 Sec. 9.5. Interest charges limited. A licensee or person 8 authorized to provide health care services under this Act may 9 not impose interest charges with respect to the unpaid 10 balance of a consumer's bill as long as the consumer is 11 making regular payments of more than $50 per month on the 12 unpaid balance. 13 Section 40. The Supportive Residences Licensing Act is 14 amended by adding Section 22 as follows: 15 (210 ILCS 65/22 new) 16 Sec. 22. Interest charges limited. A licensee or person 17 authorized to provide health care services under this Act may 18 not impose interest charges with respect to the unpaid 19 balance of a consumer's bill as long as the consumer is 20 making regular payments of more than $50 per month on the 21 unpaid balance. 22 Section 45. The Hospital Licensing Act is amended by 23 adding Section 6.18 as follows: 24 (210 ILCS 85/6.19 new) 25 Sec. 6.19. Interest charges limited. A licensee or 26 person authorized to provide health care services under this 27 Act may not impose interest charges with respect to the 28 unpaid balance of a consumer's bill as long as the consumer -4- LRB9010064JSgc 1 is making regular payments of more than $50 per month on the 2 unpaid balance. 3 Section 50. The Acupuncture Practice Act is amended by 4 adding Section 107 as follows: 5 (225 ILCS 2/107 new) 6 Sec. 107. Interest charges limited. A licensee or person 7 authorized to provide health care services under this Act may 8 not impose interest charges with respect to the unpaid 9 balance of a consumer's bill as long as the consumer is 10 making regular payments of more than $50 per month on the 11 unpaid balance. 12 Section 55. The Clinical Psychologist Licensing Act is 13 amended by adding Section 25.5 as follows: 14 (225 ILCS 15/25.5 new) 15 Sec. 25.5. Interest charges limited. A licensee or 16 person authorized to provide health care services under this 17 Act may not impose interest charges with respect to the 18 unpaid balance of a consumer's bill as long as the consumer 19 is making regular payments of more than $50 per month on the 20 unpaid balance. 21 Section 60. The Clinical Social Work and Social Work 22 Practice Act is amended by adding Section 34.5 as follows: 23 (225 ILCS 20/34.5 new) 24 Sec. 34.5. Interest charges limited. A licensee or 25 person authorized to provide health care services under this 26 Act may not impose interest charges with respect to the 27 unpaid balance of a consumer's bill as long as the consumer 28 is making regular payments of more than $50 per month on the -5- LRB9010064JSgc 1 unpaid balance. 2 Section 65. The Illinois Dental Practice Act is amended 3 by adding Section 45.5 as follows: 4 (225 ILCS 25/45.5 new) 5 Sec. 45.5. Interest charges limited. A licensee or 6 person authorized to provide health care services under this 7 Act may not impose interest charges with respect to the 8 unpaid balance of a consumer's bill as long as the consumer 9 is making regular payments of more than $50 per month on the 10 unpaid balance. 11 Section 70. The Hearing Instrument Consumer Protection 12 Act is amended by adding Section 23.5 as follows: 13 (225 ILCS 50/23.5 new) 14 Sec. 23.5. Interest charges limited. A hearing care 15 professional may not impose interest charges with respect to 16 the unpaid balance of a consumer's bill as long as the 17 consumer is making regular payments of more than $50 per 18 month on the unpaid balance. 19 Section 75. The Marriage and Family Therapy Licensing 20 Act is amended by adding Section 157 as follows: 21 (225 ILCS 55/157 new) 22 Sec. 157. Interest charges limited. A licensee or person 23 authorized to provide health care services under this Act may 24 not impose interest charges with respect to the unpaid 25 balance of a consumer's bill as long as the consumer is 26 making regular payments of more than $50 per month on the 27 unpaid balance. -6- LRB9010064JSgc 1 Section 80. The Medical Practice Act of 1987 is amended 2 by adding Section 53.5 as follows: 3 (225 ILCS 60/53.5 new) 4 Sec. 53.5. Interest charges limited. A licensee or 5 person authorized to provide health care services under this 6 Act may not impose interest charges with respect to the 7 unpaid balance of a consumer's bill as long as the consumer 8 is making regular payments of more than $50 per month on the 9 unpaid balance. 10 Section 85. The Naprapathic Practice Act is amended by 11 adding Section 102 as follows: 12 (225 ILCS 63/102 new) 13 Sec. 102. Interest charges limited. A licensee or person 14 authorized to provide health care services under this Act may 15 not impose interest charges with respect to the unpaid 16 balance of a consumer's bill as long as the consumer is 17 making regular payments of more than $50 per month on the 18 unpaid balance. 19 Section 90. The Illinois Nursing Act of 1987 is amended 20 by adding Section 46.5 as follows: 21 (225 ILCS 65/46.5 new) 22 Sec. 46.5. Interest charges limited. A licensee or 23 person authorized to provide health care services under this 24 Act may not impose interest charges with respect to the 25 unpaid balance of a consumer's bill as long as the consumer 26 is making regular payments of more than $50 per month on the 27 unpaid balance. 28 Section 95. The Illinois Occupational Therapy Practice -7- LRB9010064JSgc 1 Act is amended by adding Section 14.5 as follows: 2 (225 ILCS 75/14.5 new) 3 Sec. 14.5. Interest charges limited. A licensee or 4 person authorized to provide health care services under this 5 Act may not impose interest charges with respect to the 6 unpaid balance of a consumer's bill as long as the consumer 7 is making regular payments of more than $50 per month on the 8 unpaid balance. 9 Section 100. The Illinois Optometric Practice Act of 10 1987 is amended by adding Section 24.5 as follows: 11 (225 ILCS 80/24.5 new) 12 Sec. 24.5. Interest charges limited. A licensee or 13 person authorized to provide health care services under this 14 Act may not impose interest charges with respect to the 15 unpaid balance of a consumer's bill as long as the consumer 16 is making regular payments of more than $50 per month on the 17 unpaid balance. 18 Section 105. The Illinois Physical Therapy Act is 19 amended by adding Section 5.5 as follows: 20 (225 ILCS 90/5.5 new) 21 Sec. 5.5. Interest charges limited. A licensee or person 22 authorized to provide health care services under this Act may 23 not impose interest charges with respect to the unpaid 24 balance of a consumer's bill as long as the consumer is 25 making regular payments of more than $50 per month on the 26 unpaid balance. 27 Section 110. The Podiatric Medical Practice Act of 1987 28 is amended by adding Section 13.5 as follows: -8- LRB9010064JSgc 1 (225 ILCS 100/13.5 new) 2 Sec. 13.5. Interest charges limited. A licensee or 3 person authorized to provide health care services under this 4 Act may not impose interest charges with respect to the 5 unpaid balance of a consumer's bill as long as the consumer 6 is making regular payments of more than $50 per month on the 7 unpaid balance. 8 Section 115. The Respiratory Care Practice Act is 9 amended by adding Section 57 as follows: 10 (225 ILCS 106/57 new) 11 Sec. 57. Interest charges limited. A licensee or person 12 authorized to provide health care services under this Act may 13 not impose interest charges with respect to the unpaid 14 balance of a consumer's bill as long as the consumer is 15 making regular payments of more than $50 per month on the 16 unpaid balance. 17 Section 120. The Professional Counselor and Clinical 18 Professional Counselor Licensing Act is amended by adding 19 Section 77 as follows: 20 (225 ILCS 107/77 new) 21 Sec. 77. Interest charges limited. A licensee or person 22 authorized to provide health care services under this Act may 23 not impose interest charges with respect to the unpaid 24 balance of a consumer's bill as long as the consumer is 25 making regular payments of more than $50 per month on the 26 unpaid balance. 27 Section 125. The Illinois Speech-Language Pathology and 28 Audiology Practice Act is amended by adding Section 31.5 as 29 follows: -9- LRB9010064JSgc 1 (225 ILCS 110/31.5 new) 2 Sec. 31.5. Interest charges limited. A licensee or 3 person authorized to provide health care services under this 4 Act may not impose interest charges with respect to the 5 unpaid balance of a consumer's bill as long as the consumer 6 is making regular payments of more than $50 per month on the 7 unpaid balance.
