90_HB3340 New Act Creates the Illinois Learning with the Arts Act. Provides that the State Board of Education, Illinois Arts Council, and Board of Higher Education shall enter into an intergovernmental agreement in accordance with the Intergovernmental Cooperation Act to integrate, coordinate, and maximize benefits available under other programs that promote the use, understanding, and appreciation of the visual and performing arts as a part of the educational curriculum in the public schools, from the pre-school level through grade 12. Provides that the emphasis of the Illinois Learning with the Arts Program shall be upon the efficient use of resources to present a comprehensive but non-duplicative array of visual and performing arts programs. Adds provisions relative to use under the intergovernmental agreement of appropriations made to the parties to that agreement for programs that may be administered in a more efficient and coordinated manner under the intergovernmental agreement. Also authorizes appropriations in fiscal years after fiscal year 1999 for distribution to the intergovernmental agreement's governing body to administer visual and performing arts programs that replace those previously administered by one or more of the parties to the intergovernmental agreement. LRB9010494THpk LRB9010494THpk 1 AN ACT relating to a program for the arts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Illinois Learning with the Arts Act. 6 Section 5. Creation of program. The Illinois Learning 7 with the Arts Program is hereby created. The program shall 8 be funded through and jointly administered and implemented by 9 the State Board of Education, the Illinois Arts Council, and 10 the Board of Higher Education under an intergovernmental 11 agreement entered into by and among them in accordance with 12 the Intergovernmental Cooperation Act. 13 Section 10. Purpose and operation of program. The 14 program (i) shall be under the direction of the joint 15 administrative board or other entity created by the 16 intergovernmental agreement as the governing body for the 17 program, and (ii) shall be designed to integrate, coordinate, 18 and maximize benefits under other programs that promote the 19 use, understanding, and appreciation of the visual and 20 performing arts as a part of the educational curriculum in 21 the public schools, from the pre-school level through grade 22 12. The Illinois Learning with the Arts Program shall also 23 encourage the cooperative development and implementation of 24 innovative concepts that find their application in (i) State 25 assessment of student performance and participation in the 26 arts, and (ii) interinstitutional programs for those students 27 in recognized teacher training institutions who are preparing 28 to qualify for separate certification designation in the fine 29 arts or related areas designated as provided in Section 21-4 30 of the School Code. -2- LRB9010494THpk 1 Section 15. Funding and personnel. The emphasis of the 2 Illinois Learning with the Arts Program shall be upon the 3 efficient use of resources to present a comprehensive but 4 non-duplicative array of programs that will provide a forum 5 in which Illinois youth may express its creativity and enrich 6 its cultural horizons by meaningful exposure to and 7 participation in music, drama, dance, sculpture, painting, 8 and other visual and performing arts. To that end, beginning 9 with fiscal year 1999 and in each fiscal year thereafter, the 10 State Board of Education, Illinois Arts Council, and Board of 11 Higher Education may allocate such portion of their 12 respective appropriations for an expense, service, or grant 13 that could also be incurred, performed, or distributed for 14 the same purpose under the intergovernmental agreement but in 15 a more efficient and coordinated manner to the joint 16 administrative board or other entity created by the 17 intergovernmental agreement as the governing body of the 18 Illinois Learn with the Arts Program. In fiscal year 2000 19 and thereafter, from an additional appropriation made to any 20 entity party to the intergovernmental agreement for direct 21 distribution as a grant to the joint administrative board or 22 other governing body of the intergovernmental agreement, that 23 joint administrative board or governing body may administer 24 implementation of visual and performing arts programs in the 25 public schools, from the pre-school level through grade 12, 26 that replace duplicative or uncoordinated programs formerly 27 administered separately by one or more of the parties to the 28 intergovernmental agreement. Each entity that is a party to 29 the intergovernmental agreement may provide to the governing 30 body of that agreement such personnel, services, equipment, 31 and facilities as may be within its lawful power to provide 32 and necessary for the effective administration and 33 implementation of the intergovernmental agreement. -3- LRB9010494THpk 1 Section 99. Effective date. This Act takes effect July 2 1, 1998.
