      705 ILCS 405/3-33         from Ch. 37, par. 803-33
          Amends the Juvenile Court Act of 1987.  Permits the court
      to order a parent or guardian of a truant minor  in  need  of
      supervision  to  attend  school,  from time to time, with the
      truant minor or as the court  otherwise  directs.   Effective
      immediately.

 1        AN  ACT  to  amend  the  Juvenile  Court  Act  of 1987 by
 2    changing Section 3-33.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The Juvenile Court Act of 1987 is amended by
 6    changing Section 3-33 as follows:
 7        (705 ILCS 405/3-33) (from Ch. 37, par. 803-33)
 8        Sec. 3-33.  Truant Minor in Need of Supervision.
 9        (a)  Definition.  A minor who is reported by  a  regional
10    superintendent  of  schools,  or  in  cities  of over 500,000
11    inhabitants, by the Office of Chronic Truant Adjudication, as
12    a chronic truant shall be adjudged a truant minor in need  of
13    supervision.
14        (a-1)  There  is  a rebuttable presumption that a chronic
15    truant is a truant minor in need of supervision.
16        (a-2)  There is  a  rebuttable  presumption  that  school
17    records of a minor's attendance at school are authentic.
18        (a-3)  For purposes of this Section, "chronic truant" has
19    the  meaning  ascribed  to  it in Section 26-2a of the School
20    Code.
21        (b)  Kinds of dispositional orders.  A minor found to  be
22    a truant minor in need of supervision may be:
23        (1)  committed    to    the    appropriate       regional
24    superintendent  of  schools  for  a  multi-disciplinary  case
25    staffing, individualized educational plan or service plan, or
26    referral to comprehensive community-based youth services;
27        (2)  required   to   comply   with   an    individualized
28    educational  plan or service plan as specifically provided by
29    the appropriate regional superintendent of schools;
30        (3)  ordered to obtain  counseling  or  other  supportive
31    services;

 1        (4)  subject  to a fine in an amount in excess of $5, but
 2    not exceeding $100, for each offense and each day of  absence
 3    without valid cause as defined in Section 26-2a of The School
 4    Code is a separate offense;
 5        (5)  required  to  perform some reasonable public service
 6    work such as, but not limited to, the picking up of litter in
 7    public parks or along public highways or the  maintenance  of
 8    public facilities; or
 9        (6)  subject  to  having  his  or her driver's license or
10    privilege suspended; or .
11        (7)  ordered to have  his  or  her  parents  or  guardian
12    attend school from time to time with the truant minor in need
13    of supervision or as the court otherwise directs.
14        A dispositional order may include a fine, public service,
15    or  suspension of a driver's license or privilege only if the
16    court has made an express  written  finding  that  a  truancy
17    prevention  program  has been offered by the school, regional
18    superintendent of schools,  or  a  community  social  service
19    agency to the truant minor in need of supervision.
20        (c)  Orders entered under this Section may be enforced by
21    contempt proceedings.

24        Section 99.  Effective date.  This Act takes effect  upon
25    becoming law.
