Defines multi-family, single-family, and duplex residential structures. LRB9009809PTsbA LRB9009809PTsbA 1 AN ACT to amend the Truss Construction Fire Safety Act by 2 changing Sections 5, 10, and 15. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Truss Construction Fire Safety Act is 6 amended by changing Sections 5, 10, and 15 as follows: 7 (425 ILCS 68/5) 8 Sec. 5. Definitions. For the purposes of this Act: 9 "Duplex residential structure" means a building 10 containing 2 residential dwelling units for 2 households 11 living independently of each other. 12 "Multi-family residential structure" means a building 13 containing 3 or more residential dwelling units for 3 or more 14 households living independently of each other. 15 "Single-family residential structure" means a building 16 containing one residential dwelling unit. 17 "Truss" means a framed structural unit made up of a group 18 of triangles arranged in a single plane in such a manner that 19 if loads are applied at the points of intersection of the 20 truss members, only compressive or tensile (nonbending) 21 forces will result in the members. 22 "Truss construction" means a structure, excluding a 23 residential structure, in which the roof or floor is 24 supported by trusses. 25 (Source: P.A. 90-434, eff. 8-16-97.) 26 (425 ILCS 68/10) 27 Sec. 10. Display requirement. 28 (a) A municipality may by ordinance require that a truss 29 construction emblem be affixed to the front of all or any 30 class of structures, excluding single-family or duplex -2- LRB9009809PTsbA 1 residential structures, within the municipality that have 2 truss construction. 3 (b) A county may by ordinance require that a truss 4 construction emblem be affixed to the front of all or any 5 class of structures, excluding single-family or duplex 6 residential structures, within the unincorporated area of the 7 county that have truss construction. 8 (c) Where individual structures, excluding single-family 9 or duplex residential structures, with truss construction are 10 part of a planned unit development or subdivision, the 11 municipality or county may require the truss construction 12 emblem to be displayed at each entrance to the development or 13 subdivision rather than on each individual structure. 14 (Source: P.A. 90-434, eff. 8-16-97.) 15 (425 ILCS 68/15) 16 Sec. 15. Registration requirement; fee. 17 (a) A municipality or county that requires display of a 18 truss construction emblem on all or any class of structures, 19 excluding single-family or duplex residential structures, may 20 require the owners of those structures to register them with 21 the fire department or other appropriate agency of the 22 municipality or county. 23 (b) The municipality or county may charge a reasonable 24 registration fee to the owners of structures, excluding 25 multi-family residential structures, that are required to be 26 registered under subsection (a). These fees shall be used 27 for reasonable costs related to identifying, maintaining 28 records of, and inspecting structures with truss 29 construction; and any other costs of implementing, 30 administering, or enforcing an ordinance adopted under this 31 Act. 32 (c) A municipality or county may require the owners of 33 single-family or duplex residential structures that have -3- LRB9009809PTsbA 1 truss construction to register them with the fire department 2 or other appropriate agency of the municipality or county, 3 but may not charge a registration fee to the owners for those 4 structures. 5 (Source: P.A. 90-434, eff. 8-16-97.)
