90_HB3180ham001 LRB9009236JSgcam02 1 AMENDMENT TO HOUSE BILL 3180 2 AMENDMENT NO. . Amend House Bill 3180 on page 11 by 3 inserting immediately below line 16 the following: 4 "Section 5-145. Applicability of other statutes or 5 rules. Notwithstanding any provisions of this Act, if any 6 other statute or rule requires approval by a State agency 7 prior to the use or retention of electronic records or the 8 use of electronic signatures, the provisions of that other 9 statute or rule shall also apply."; and 10 on page 39 by replacing lines 5, 6, and 7 with the following: 11 "Section 95-10. The State Comptroller Act is amended by 12 changing Section 14.01 as follows: 13 (15 ILCS 405/14.01) 14 Sec. 14.01. Digital signatures. 15 (a) In any communication between a State agency and the 16 Comptroller in which a signature is required or used, any 17 party to the communication may affix a signature by use of a 18 digital signature that complies with the requirements of this 19 Section. The use of a digital signature shall have the same 20 force and effect as the use of a manual signature if and only -2- LRB9009236JSgcam02 1 if it embodies all of the following attributes: 2 (1) It is unique to the person using it. 3 (2) It is capable of verification. 4 (3) It is under the sole control of the person 5 using it. 6 (4) It is linked to data in such a manner that if 7 the data are changed, the digital signature is 8 invalidated. 9 (5) It conforms to regulations adopted by the 10 Comptroller, which shall not conflict with the minimum 11 security requirements specified by the Secretary of State 12 under the Electronic Commerce Security Act. 13 (b) The use or acceptance of a digital signature shall 14 be at the option of the parties. Nothing in this Section 15 shall require a State agency to use or permit the use of a 16 digital signature. 17 (c) "Digital signature" has the meaning ascribed to that 18 term in the Electronic Commerce Security Actmeans an19electronic identifier, created by computer, intended by the20party using it to have the same force and effect as the use21of a manual signature. 22 (Source: P.A. 90-37, eff. 6-27-97.)".
