LRB9009507JSmg LRB9009507JSmg 1 AN ACT to amend the Public Utilities Act by changing 2 Section 9-102. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Utilities Act is amended by 6 changing Section 9-102 as follows: 7 (220 ILCS 5/9-102) (from Ch. 111 2/3, par. 9-102) 8 Sec. 9-102. Filing of rates and charges. Every public 9 utility shall file with the Commission and shall print and 10 keep open to public inspection schedules showing all rates 11 and other charges, and classifications, which are in force at 12 the time for any product or commodity furnished or to be 13 furnished by it, or for any service performed by it, or for 14 any service in connection therewith, or performed by any 15 public utility controlled or operated by it. Every public 16 utility shall file with and as a part of such schedule and 17 shall state separately all rules, regulations, storage or 18 other charges, privileges and contracts that in any manner 19 affect the rates charged or to be charged for any service. 20 Such schedule shall be filed for all services performed 21 wholly or partly within this State, and the rates and other 22 charges and classifications shall not, without the consent of 23 the Commission, exceed those in effect on December 31, 1985. 24 But nothing in this section shall prevent the Commission from 25 approving or fixing rates or other charges or classifications 26 from time to time, in excess of or less than those shown by 27 said schedules. 28 Where a schedule of joint rates or other charges, or 29 classifications is or may be in force between two or more 30 public utilities such schedules shall in like manner be 31 printed and filed with the Commission, and so much thereof as -2- LRB9009507JSmg 1 the Commission shall deem necessary for the use of the public 2 shall be filed in every office of such public utility in 3 accordance with the terms of Section 9-103 of this Act. 4 Unless otherwise ordered by the Commission a schedule showing 5 such joint rates or other charges, or classifications need 6 not be filed with the Commission by more than one of the 7 parties to it: Provided, that there is also filed with the 8 Commission a concurrence in such schedule by each of the 9 other parties thereto. 10 Every public utility shall file with the Commission 11 copies of all contracts, agreements or arrangements with 12 other public utilities, in relation to any service, product 13 or commodity affected by the provisions of this Act, to which 14 it may be a party, and copies of all other contracts, 15 agreements or arrangements with any other person or 16 corporation affecting in the judgment of the Commission the 17 cost to such public utility of any service, product or 18 commodity. 19 (Source: P.A. 84-617; 84-1025.)
