LRB901119MWpc LRB901119MWpc 1 AN ACT to amend the Government Salary Withholding Act by 2 changing Section 3. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Government Salary Withholding Act is 6 amended by changing Section 3 as follows: 7 (50 ILCS 125/3) (from Ch. 85, par. 473) 8 Sec. 3. Insurance. Any local governmental agency, 9 unless otherwise provided in any statute specifically 10 creating or governing any such agency, may provide for the 11 benefit of its employees, elected or appointed officials and 12 retired former employees life or group life, health, 13 accident, hospital and medical insurance, or any combination 14 of thosesuchtypes of insurance. TheSuchinsurance may 15 include provision for employees, elected or appointed 16 officials and former employees who rely on treatment by 17 prayer or spiritual means alone for healing in accordance 18 with the tenets and practice of a well recognized religious 19 denomination. The corporate authority of thesuchagency may 20 provide for payment by thesuchagency of a portion of the 21 premium or charge for such insurance for these persons with 22 these persons paying the balance of thesuchpremium charge. 23 However, the portion to be paid by the agency shall not 24 exceed 30% of an elected official's salary from that 25 governmental unit for that premium period, or if paid on a 26 per diem basis, for the previous premium period. There shall 27 be no limit to the portion paid by the agency for full-time 28 elected officials. For purposes of this Section, a full-time 29 elected official is one who works 20 hours or more per week. 30 Notwithstanding the preceding provisions, there shall be no 31 limit to the portion paid by a township for a trustee of the -2- LRB901119MWpc 1 township. If thesuchcorporate authority undertakes a plan 2 whereunder the local governmental agency pays a portion of 3 thesuchpremium or charge, the corporate authority of the 4suchagency shall provide for the withholding and deducting 5 from the compensation of anysuchpersons thatasconsent to 6 joining thesuchplan, the balance of the premium or charge 7 for thesuchinsurance. 8 If the local governmental agency does not provide for a 9 plan pursuant to which thesuchagency pays a portion of the 10 premium or charge for any group insurance plan, the corporate 11 authority of such agency may provide for the withholding and 12 deducting from the compensation of such persons as consent 13 thereto, and the governing authority of any retirement system 14 covering employees or elected or appointed officials of a 15 local governmental agency may provide for the withholding and 16 deducting from retirement benefits of such former persons as 17 consent thereto, the premium or charge for any life or group 18 life, health, accident, hospital and medical insurance. 19 Notwithstanding any other provisions of this Act, nothing 20 in this Section shall apply to any municipality or county. 21 (Source: P.A. 86-533.)
