Amend House Bill 2896 on page 4, by 3 replacing lines 20 through 32 with the following: 4 "effectuation of management policies and practices. No 5 employee shall be considered a "managerial employee" because 6 he or she belongs to a classification of employees to whom 7 executive and management functions may be delegated in the 8 absence of proof that a particular employee has actually 9 received such a delegation on a regular basis. The statutory 10 authority of an employer to delegate executive and management 11 functions to an employee shall not be determinative of the 12 employee's status as a "managerial employee". No employee 13 shall be considered a "managerial employee" because he or she 14 performs professional duties. In determining an employee's 15 status as a "managerial employee", the Board shall be limited 16 to considering the employee's actual job duties and 17 responsibilities and the extent to which the employee has 18 actual authority concerning the overall operations and 19 governance of the office in which the employee works.".
