Amends the Vehicle Code to provide that neither the State
nor any unit of local government owes a duty to keep safe
premises for all-terrain vehicle users or to warn all-terrain
vehicle operators of hazards on property in which a
government body has an interest.

1 AN ACT to amend the Illinois Vehicle Code by adding
2 Section 11-1426.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 adding Section 11-1426.5 as follows:
7 (625 ILCS 5/11-1426.5 new)
8 Sec. 11-1426.5. All-terrain vehicles; no duty of care or
9 to warn. Notwithstanding any other provision of law to the
10 contrary, neither the State nor any unit of local government
11 owes any duty of care to keep any premises safe for entry or
12 use by others for all-terrain vehicles or to give warnings of
13 any condition, use, structure, or activity on property in
14 which the State or any unit of local government has an
15 interest.
