90_HB2860ham001 LRB9009861JSmgam 1 AMENDMENT TO HOUSE BILL 2860 2 AMENDMENT NO. . Amend House Bill 2860 on page 1 by 3 replacing lines 8 and 9 with the following; 4 "Sec. 155.22b. Rating, claims handling, and underwriting 5 decisions. 6 (a) No company may use the fact that an applicant or 7 insured incurred bodily"; and 8 on page 1 by inserting immediately below line 12 the 9 following: 10 "(b) If a policy excludes property coverage for 11 intentional acts, the insurer may not deny payment to an 12 innocent co-insured who did not cooperate in or contribute to 13 the creation of the loss if the loss arose out of a pattern 14 of criminal domestic violence and the perpetrator of the loss 15 is criminally prosecuted for the act causing the loss. 16 Payment to the innocent co-insured may be limited to his or 17 her ownership interest in the property as reduced by any 18 payments to a mortgagor or other secured interest.".
