Amend House Bill 2746, on page 1, by 3 replacing the title with the following: 4 "AN ACT concerning property, amending named Acts."; and 5 on page 1, by inserting immediately after the enacting clause 6 the following: 7 "Section 5. The Illinois Municipal Code is amended by 8 changing Section 11-90-5 as follows: 9 (65 ILCS 5/11-90-5) 10 Sec. 11-90-5. The Capital City Railroad Relocation 11 Authority; transfer of property and powers. 12 (a) Effective December 31, 1996: 13 (1) All of the property still vested in the Capital 14 City Railroad Relocation Authority on that date for 15 Useable Segment 3 shall thereupon vest in the City of 16 Springfield, which shall have the power to sell, 17 transfer, exchange, or assign that property as it shall 18 deem appropriate, subject to the agreements that the 19 Authority had entered into with respect to that property; 20 and 21 (2) All of the statutory powers and duties, -2- LRB9008778KSmgam05 1 including but not limited to the power to acquire 2 property exchanged by the railroads for the railroad 3 right-of-way acquired by the Authority and to sell, 4 transfer, exchange, or assign property as it shall deem 5 appropriate, which the Authority had to implement the 6 agreements that it entered into for Useable Segment 3, 7 are transferred to the City of Springfield only for 8 implementation of those agreements and subject to them. 9 (b) Once the City of Springfield has completed 10 transactions required to perform the agreements referred to 11 in subdivisions (1) and (2) of subsection (a), its powers and 12 duties under this Section shall terminate. 13 (c) The City of Springfield shall obtain a certified 14 copy of the portions of this amendatory Act of 1996 15 containing the title, the enacting clause, the effective 16 date, and this Section and the appropriate land descriptions 17 of property to be transferred within 60 days after its 18 effective date and shall record the certified document in the 19 Recorder's Office of Sangamon County. 20 (d) If this Section takes effect after December 31, 21 1996, then its provisions apply retrospectively from December 22 31, 1996. 23 (e) This Section is repealed on June 30, 1999June 30,241998. 25 (Source: P.A. 89-699, eff. 1-16-97.)"; and 26 on page 1, line 5, by changing "Section 5" to "Section 10"; 27 and 28 on page 2, after line 22, by inserting the following: 29 "Section 99. Effective date. This Section and the 30 changes to Section 11-90-5 of the Illinois Municipal Code 31 take effect upon becoming law.".
