1 AMENDMENT TO HOUSE BILL 2667
2 AMENDMENT NO. . Amend House Bill 2667 on page 4,
3 line 11, by changing "(1)" to "(i)"; and
4 on page 4, by replacing lines 27 through 34 with the
5 following:
6 "(ii) As used in paragraph (d) and this paragraph
7 (e) of this subsection (2):
8 (A) "Rail carrier" means the same as a
9 "railroad" as defined in 49 U.S.C. 20102 that
10 operates or controls moving equipment over trackage
11 (I) that has public grade crossings, (II) that has
12 passenger revenue, or (III) where hazardous
13 materials are moving in transit."; and
14 on page 5, line 1, by changing "(ii)" to "(B)"; and
15 on page 5, line 6, by changing "(iii)" to "(C)"; and
16 on page 5, immediately below line 10, by inserting the
17 following:
18 "(D) "Remote control" does not include:
19 (I) the use of, testing of, or reliance
20 upon any train control device, signal, radio,
21 or computer or interconnected system of a train
22 control device, signal, radio, or computer used

1 to enhance the safety of rail operations by
2 allowing remote observation or monitoring of
3 train location and operation, including devices
4 used to stop or otherwise control a train to
5 avoid unsafe situations or operations;
6 (II) devices used to interface train
7 operations with protective or warning devices
8 at grade crossings with public roads, including
9 devices used to activate the crossing devices
10 in advance of train arrival, to observe or to
11 otherwise determine the presence of vehicles on
12 or proximate to the crossings, or to stop or
13 otherwise control a train to avoid an accident
14 at the crossings; or
15 (III) a train consist which is operated
16 by a control cab that is not a power unit.".
