Includes certificated employees of a regional office of education among the employees for which the State Board of Education is to provide or arrange to have provided specified liability insurance coverage without cost to the person accepting the coverage. Effective immediately. LRB9008987THpk LRB9008987THpk 1 AN ACT to amend the School Code by changing Section 2 2-3.124. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The School Code is amended by changing 6 Section 2-3.124 as follows: 7 (105 ILCS 5/2-3.124) 8 Sec. 2-3.124. Liability coverage for certificatedschool9 employees of schools and regional offices of education. 10 Beginning with the 1998-99 school year, the State Board of 11 Education shall provide or arrange to have provided for each 12 certificated person who receives a salary or wages in 13 exchange for performing educational employment activities on 14 behalf of a school board, board of trustees, joint agreement 15 program board, cooperative program board,orsimilar 16 governing body of a public elementary or secondary 17 educational unit, or regional office of education in Illinois 18 educators liability coverage in amounts no less than: (1) 19 $1,000,000 per person per occurrence, not to include any 20 civil rights issue or claims; (2) $250,000 per person per 21 occurrence for any civil rights issue or claims and not to 22 include any other claims; and (3) $3,000,000 per occurrence 23 aggregate for all claims. 24 The coverage provided by the State Board shall also 25 include: (1) reimbursement of attorney fees for defense of a 26 criminal proceeding in an amount not less than $35,000 per 27 proceeding; (2) bail bond coverage of not less than $1,000 28 per bond; and (3) assault-related personal property damage 29 coverage of not less than $250 per incident. 30 The liability coverage required by this Section shall be 31 provided at no cost to the covered persons accepting such -2- LRB9008987THpk 1 coverage. 2 The State Board shall adopt such rules and regulations as 3 are necessary to implement the provisions of this Section. 4 (Source: P.A. 90-548, eff. 1-1-98.) 5 Section 99.
