Amends the Livestock Management Facilities Act.
Prohibits the commencement of operation of new livestock
management or waste handling facilities of 1,000 or more
animal units (and the commencement of operation of the
expanded portions of expanded facilities) during 1998.

1 AN ACT to amend the Livestock Management Facilities Act
2 by adding Section 12.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Livestock Management Facilities Act is
6 amended by adding Section 12 as follows:
7 (510 ILCS 77/12 new)
8 Sec. 12. Moratorium.
9 (a) Notwithstanding any other provision of this Act or
10 any other provision of law, if any new facility as defined in
11 Section 10.45 of 1,000 or more animal units has not commenced
12 operations before the effective date of this amendatory Act,
13 then during calendar year 1998 no construction may be
14 commenced or continued and no operations may be commenced
15 with respect to that facility.
16 (b) Notwithstanding any other provision of this Act or
17 any other provision of law, if any new facility as defined in
18 Section 10.45 (regardless of whether it is classified as a
19 "new facility" before or after expansion) has commenced
20 operations before the effective date of this amendatory Act,
21 then during calendar year 1998 no expansion of that facility
22 may be commenced or continued and no operations may be
23 commenced with respect to the expansion of that facility if
24 either before or after the expansion it is or will be a new
25 facility of 1,000 or more animal units.
26 Section 99. Effective date. This Act takes effect upon
27 becoming law.
