LRB9007922DPcw LRB9007922DPcw 1 AN ACT concerning school psychologists, amending named 2 Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The School Code is amended by changing 6 Section 14-1.09 as follows: 7 (105 ILCS 5/14-1.09) (from Ch. 122, par. 14-1.09) 8 Sec. 14-1.09. School psychologist. 9 (a) "School psychologist" means a psychologist who has 10 graduated with a master's or higher degree in psychology or 11 educational psychology from an institution of higher learning 12 which maintains equipment, courses of study, and standards of 13 scholarship approved by the State Board of Education, who has 14 had at least one school year of full-time supervised 15 experience in the delivery of school psychological services 16 of a character approved by the State Superintendent of 17 Education, who has such additional qualifications as may be 18 required by the State Board of Education, and who holds a 19 School Service Personnel Certificate endorsed for school 20 psychology issued pursuant to Section 21-25. Persons so 21 certified may use the title "school psychologist" and may 22 offer school psychological services which are limited to 23 those services set forth in (i) 23 Ill. Adm. Code 226, 24 Special Education, pertaining to children between the ages of 25 3 to 21, promulgated by the State Board of Education and in 26 (ii) Section 14-1.09.1. School psychologists may make 27 evaluations, recommendations or interventions regarding the 28 placement of children in educational programs or special 29 education classes. However, a school psychologist shall not 30 provide such services outside his or her employment to any 31 student in the district or districts which employ such school -2- LRB9007922DPcw 1 psychologist. 2 (b) The State Teacher Certification Board shall by rule 3 establish a procedure for licensed clinical psychologists to 4 apply for certification as school psychologists. 5 (Source: P.A. 85-361.) 6 Section 10. The Professional Counselor and Clinical 7 Professional Counselor Licensing Act is amended by changing 8 Section 45 as follows: 9 (225 ILCS 107/45) 10 Sec. 45. Qualifications for a license. 11 (a) Professional counselor. A person is qualified to be 12 licensed as a licensed professional counselor, and the 13 Department shall issue a license authorizing the practice of 14 professional counseling to an applicant who: 15 (1) has applied in writing on the prescribed form 16 and has paid the required fee; 17 (2) is at least 21 years of age and has not engaged 18 in conduct or activities which would constitute grounds 19 for discipline under this Act; 20 (3) is a graduate of: 21 (A) a master's or doctoral level program in 22 the field of counseling, rehabilitation counseling, 23 psychology, or similar degree program approved by 24 the Department; or 25 (B) an approved baccalaureate program in human 26 services or similar degree program approved by the 27 Department and can document the equivalent of 5 28 years of full-time satisfactory supervised 29 experience, as established by rule, under a 30 qualified supervisor; 31 (4) has passed an examination for the practice of 32 professional counseling as authorized by the Department; -3- LRB9007922DPcw 1 and 2 (5) has paid the fees required by this Act. 3 Any person who has received certification by any State or 4 national organization whose standards are accepted by the 5 Department as being substantially similar to the standards in 6 this Act may apply for a professional counselor license and 7 need not be examined further. 8 (b) Clinical professional counselor. A person is 9 qualified to be licensed as a clinical professional 10 counselor, and the Department shall issue a license 11 authorizing the practice of clinical professional counseling 12 to an applicant who: 13 (1) has applied in writing on the prescribed form 14 and has paid the required fee; 15 (2) is at least 21 years of age and has not engaged 16 in conduct or activities which would constitute grounds 17 for discipline under this Act; 18 (3) is a graduate of: 19 (A) a master's level program in the field of 20 counseling, rehabilitation counseling, psychology, 21 or similar degree program approved by the Department 22 and has completed the equivalent of 2 years 23 full-time satisfactory supervised employment or 24 experience working as a clinical professional 25 counselor under the direction of a qualified 26 supervisor subsequent to the degree; or 27 (B) a doctoral program in the field of 28 counseling, rehabilitation counseling, psychology, 29 or similar program approved by the Department and 30 has completed the equivalent of 2 years full-time 31 satisfactory supervised employment or experience 32 working as a clinical professional counselor under 33 the direction of a qualified supervisor, at least 34 one year of which is subsequent to the degree; -4- LRB9007922DPcw 1 (4) has passed the examination for the practice of 2 clinical professional counseling as authorized by the 3 Department; and 4 (5) has paid the fees required by this Act. 5 Any person who has received certification by any State or 6 national organization whose standards are accepted by the 7 Department as being substantially similar to the standards in 8 this Act may apply for a clinical professional counselor 9 license, and need not be examined further. 10 (b-5) Licensed school psychologist. A Type 73 certified 11 school psychologist who holds the title of Nationally 12 Certified School Psychologist (NCSP) may take the clinical 13 professional counseling examination provided under subsection 14 (b) and, upon passage of the examination and completion of 15 all other requirements of subsection (b), shall be designated 16 by the Department as a licensed school psychologist and shall 17 be authorized to practice clinical professional counseling in 18 accordance with this Act. 19 (c) Examination for applicants under this Act shall be 20 held at the discretion of the Department from time to time 21 but not less than once each year. The examination used shall 22 be authorized by the Department. 23 (d) Upon application and payment of the required fee, an 24 applicant who has an active license as a clinical 25 psychologist or a clinical social worker licensed under the 26 laws of this State may, without examination, be granted 27 registration as a licensed clinical professional counselor by 28 the Department. 29 (Source: P.A. 87-1011; 87-1269.) 30 Section 99. Effective date. This Act takes effect 31 January 1, 1999.
