Provides that the POW/MIA flag shall be flown at courthouses; State penal and reformatory, educational and charitable institutions; and school houses in the State of Illinois. Provides that the United States national flag and the POW/MIA flag shall be flown at each State building and facility. LRB9007735MWpc LRB9007735MWpc 1 AN ACT to amend the Flag Display Act by changing Sections 2 1, 2, and 3 and by adding Section 2a. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Flag Display Act is amended by changing 6 Sections 1, 2, and 3 and by adding Section 2a as follows: 7 (5 ILCS 465/1) (from Ch. 1, par. 3301) 8 Sec. 1. Court houses. It shall be the duty of each 9 county board to provide United States national flags of not 10 less than four by eight feet in size and POW/MIA flags, to be 11 unfurled and kept floating from a suitable flag-staff to be 12 placed on the top of the court house in its respective 13 county, and it is hereby made the duty of the sheriff of each 14 and every county in the state to see that the flagsflagso 15 provided shall be hoisted on theiritsflag-staff above the 16 court house and kept floating from eight o'clock a. m. to 17 five o'clock p. m. on each and every legal holiday of the 18 year, and on such other days as the county board may direct. 19 The POW/MIA flag shall be flown below the United States 20 national flag. 21 (Source: P.A. 86-1028.) 22 (5 ILCS 465/2) (from Ch. 1, par. 3302) 23 Sec. 2. State institutions. The commissioners or 24 trustees of all penal and reformatory, State educational and 25 state charitable institutions of this State shall provide 26 United States national flags of not less than ten by twenty 27 feet in size and POW/ MIA flags and cause the same to be 28 unfurled and kept floating above the said penal and 29 reformatory, state educational and state charitable 30 institutions or on a suitable flag pole from eight o'clock a. -2- LRB9007735MWpc 1 m. to five o'clock p. m. on each and every legal holiday in 2 the year and on such other days as the commissioners or 3 trustees may determine. The POW/MIA flag shall be flown 4 below the United States national flag. 5 (Source: Laws 1897, p. 229.) 6 (5 ILCS 465/2a new) 7 Sec. 2a. State buildings and facilities. A United 8 States national flag and a POW/MIA flag shall be unfurled and 9 kept floating above each State building or facility or on a 10 suitable flag pole from 8 o'clock a.m. to 5 o'clock p.m. on 11 each and every legal holiday in the year and on any other 12 days that the Governor may determine. The POW/MIA flag shall 13 be flown below the United States national flag. 14 (5 ILCS 465/3) (from Ch. 1, par. 3303) 15 Sec. 3. School houses and school grounds. The directors 16 or board of education of every school district in the State 17 of Illinois shall cause to be erected and shall keep in 18 repair on all public school houses or within the school 19 grounds surrounding such public school buildings which may be 20 in their respective school districts, a good and sufficient 21 flag-staff or pole, together with all necessary adjustments, 22 and shall provide a United States national flag of not less 23 than four by eight feet in size and a POW/MIA flag, which 24 shall be floated from such flag-staff or pole during the 25 school hours of such days as the directors or board of 26 education may determine: Provided, that the flag shall not be 27 hoisted on any court house, state institution or public 28 school building during any day when a violent storm or 29 inclement weather would destroy or materially injure such 30 flag.
