90_HB2415 415 ILCS 5/22 from Ch. 111 1/2, par. 1022 Amends the Environmental Protection Act to make technical changes in the Section concerning the adoption of regulations. LRB9008012LDdv LRB9008012LDdv 1 AN ACT to amend the Environmental Protection Act by 2 changing Section 22. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Environmental Protection Act is amended 6 by changing Section 22 as follows: 7 (415 ILCS 5/22) (from Ch. 111 1/2, par. 1022) 8 Sec. 22. In accord with Title VII of this Act, the 9 Board may adopt regulations to promote the purposes of this 10 Title. Without limiting the generality of this authority, 11 thesesuchregulations may among other things prescribe the 12 following: 13 (a) Standards for the location, design, construction, 14 sanitation, operation, maintenance, and discontinuance of the 15 operation of refuse collection and disposal, storage and 16 treatment sites and facilities and resource conservation and 17 recovery sites and facilities; 18 (b) Standards for the dumping of any refuse,and 19 standards for the handling, storing, processing, transporting 20 and disposal of any hazardous waste; 21 (c) Requirements and standards for the keeping of 22 records and the reporting and retaining of data collected by 23 generators, processors, storers, transporters, handlers, 24 treaters, and disposers of special or hazardous waste; 25 (d) Requirements and standards for equipment and 26 procedures for monitoring contaminant discharges at their 27 source, the collection of samples and the collection, 28 reporting, and retention of data resulting from thatsuch29 monitoring; 30 (e) Alert and abatement standards relative to land 31 pollution emergencies constituting an acute danger to health -2- LRB9008012LDdv 1 or to the environment; 2 (f) Requirements and standards for adequate and proper 3 care and maintenance of, closure of, and post-closure 4 monitoring, maintenance, and use of hazardous waste disposal 5 sites; 6 (g) Requirements to prohibit the disposal of certain 7 hazardous wastes in sanitary landfills where, after 8 regulatory proceedings held in conformance with Title VII of 9 this Act, it is determined by the Board that the long term 10 impacts to public health and the environment are such that 11 land burial should not be allowed and where an economically 12 reasonable, technically feasible, and environmentally sound 13 alternative is available for processing, recycling, fixation, 14 or neutralization of such wastes. The agency shall 15 participate in all such proceedings. No such prohibition may 16 become effective unless a specific alternative technology 17 meeting the criteria of this subsection is identified by the 18 Board. Nothing in this subsection shall prohibit the land 19 burial of any hazardous waste which is the subject of review 20 under this subsection until such time as a final prohibition 21 order is issued by the Board. 22 (Source: P.A. 83-425.)
