Amend House Bill 2375 by replacing 3 the title with the following: 4 "AN ACT to amend the Chicago Park District Act by 5 changing Section 15 and by adding Sections 15b and 15c."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Chicago Park District Act is amended by 9 changing Section 15 and adding Sections 15b and 15c as 10 follows: 11 (70 ILCS 1505/15) (from Ch. 105, par. 333.15) 12 Sec. 15. Acquisition of real estate. 13 (a) The Chicago Park District may acquire by gift, 14 grant, purchase, or condemnation (and may incur indebtedness 15 for the purchase of) any real estate lands, riparian estates 16 or rights, and other property (including abandoned railroad 17 rights-of-way) required or needed for any park, for parkways, 18 driveways, or boulevards, or for extending, adorning, or 19 maintaining the same for the purpose of establishing, 20 acquiring, completing, enlarging, ornamenting, building, -2- LRB9007361PTbdam 1 rebuilding, and improving public parks, boulevards, bridges, 2 subways, viaducts, and approaches thereto, wharfs, piers, 3 jetties, air landing fields and basins, shore protection 4 works, pleasure grounds and ways, walks, pathways, driveways, 5 roadways, highways, and all public works, grounds, or 6 improvements under the control of and within the jurisdiction 7 of the park commissioners, including (i) filling in submerged 8 land for park purposes, (ii) constructing all buildings, 9 field houses, stadiums, shelters, conservatories, museums, 10 service shops, power plants, structures, playground devices, 11 and boulevard and building lighting systems, and (iii) 12 building all other types of permanent improvement and 13 construction necessary to render the property under the 14 control of the park commissioners usable for the enjoyment of 15 that property as public parks, parkways, boulevards, and 16 pleasureways, whether the land is located within or without 17 the district, if the land is deemed necessary for park 18 purposes or for parkways, driveways, or boulevards. The 19 Chicago Park District shall have no power of condemnation, 20 however, as to real estate lands, riparian rights or estates, 21 or other property located outside the district, but shall 22 only have power to acquire that property by gift, grant, or 23 purchase. 24 (b) After December 31, 1958, the powers granted in this 25 Section are subject to and limited by the Chicago Park and 26 City Exchange of Functions Act. As provided in that Act and 27 in Section 7 of this Act, the Chicago Park District may not 28 after that date acquire, extend, and maintain boulevards, 29 driveways, roadways, and highways used as thoroughfares for 30 vehicular traffic into or within parks, or any bridges, 31 subways, viaducts, and approaches thereto. 32 (c) The Chicago Park District may acquire by lease or 33 permit the right to occupy and use real estate lands and 34 riparian estates for park and parkway purposes and may -3- LRB9007361PTbdam 1 improve, maintain, and equip the lands and estates when 2 authorized by the Commissionersas a park or playground,but3no permanent building or structure shall be placed upon lands4so acquired by lease or permit. The Chicago Park District5may, however, improve, remodel, and equip buildings and6structures to make them suitable for operation by the Chicago7Park District for park purposes if, at the time of the8commencement of any improvement or remodeling, the remaining9portion of the term of the permit or lease is not less than1010 years. 11 (d) The power of condemnation conferred by this Act 12 shall be exercised in the manner provided for the exercise of 13 the right of eminent domain under Article VII of the Code of 14 Civil Procedure. 15 (Source: P.A. 87-356.) 16 (70 ILCS 1505/15b new) 17 Sec. 15b. Licenses, easements, and rights of way. In 18 addition to the other powers and authority now possessed by 19 it, the Chicago Park District shall have the power to grant 20 licenses, easements, and rights of way, subject to any 21 conditions that may be determined by the District, to 22 municipalities, corporations, or persons for the 23 construction, operation, and maintenance of facilities on, 24 under, or across any property of the Chicago Park District 25 for water, sewer, telephone, electricity, gas, or other 26 public services. 27 (70 ILCS 1505/15c new) 28 Sec. 15c. Lease for equipment and machinery. In 29 addition to the other powers and authority now possessed by 30 it, the Chicago Park District may, when authorized by the 31 Commissioners, enter into a leases for a period not to exceed 32 5 years for any equipment and machinery that may be required -4- LRB9007361PTbdam 1 for corporate purposes.".
