Amend House Bill 2359 on page 4, 3 line 14, after the period, by inserting the following: 4 "All transferred employees who are members of collective 5 bargaining units shall retain their seniority, continuous 6 service, salary, and accrued benefits. During the pendency 7 of the existing collective bargaining agreement, the rights 8 provided for under that agreement and memoranda and 9 supplements to that agreement, including, but not limited to, 10 the right of employees in the Child and Spouse Support Unit 11 to positions in other State agencies and the right of 12 employees in other State agencies covered by the agreement to 13 positions in the Child and Spouse Support Unit, shall not be 14 abridged. 15 The Office of the Attorney General shall continue to 16 honor all collective bargaining agreements in effect at the 17 time of the transfer and to recognize all collective 18 bargaining representatives for the employees who perform or 19 will perform functions transferred by this amendatory Act of 20 1997. For all purposes with respect to the management of the 21 existing agreement and the negotiation and management of any 22 successor agreements, the Attorney General shall be deemed to 23 be the employer of employees who perform or will perform 24 functions transferred by this amendatory Act of 1997; -2- LRB9007364SMdvam01 1 provided that the Illinois Department of Central Management 2 Services shall be a party to any grievance or arbitration 3 proceeding held pursuant to the provisions of the collective 4 bargaining agreement which involves the movement of employees 5 from the Office of the Attorney General to an agency under 6 the jurisdiction of the Governor covered by the agreement."; 7 and 8 on page 4, line 26, by deleting "collective bargaining 9 agreements"; and 10 on page 4, line 27, by deleting "and"; and 11 on page 241, by replacing lines 27 and 28 with the following: 12 "Section 99. Effective date. This Act takes effect on 13 July 1, 1998.".
