90_HB2323 SEE INDEX Amends the Election Code. Prohibits establishment of more than one political committee per office sought, except by legislative leaders for election of General Assembly candidates. Prohibits establishment of more than one political committee by a corporation, labor union, or association. Requires corporations, labor unions, and associations that spend more than $1,000 supporting or opposing candidates or public questions to register with the State Board of Elections and file disclosures of contributions. Limits an individual's campaign contributions to $1,500 per candidate per election; a corporation, labor union, or association without a political committee to $3,000; and a political committee to $5,000. Specifies the permitted and prohibited expenditures of a political committee's funds. Requires disclosure of an individual contributor's occupation and employer on campaign contribution and expenditure reports. Requires dissolution of a political committee within one year after an official leaves office, a candidate loses an election, or an official or candidate dies. Prohibits fundraising by General Assembly members and candidates within Sangamon County during the weeks the General Assembly is in session. Makes soliciting, offering, or accepting contributions on State property a Class A misdemeanor. Requires the State Board of Elections to adopt rules to allow electronic filing of a political committee's campaign finance reports. Changes from a Class B to a Class A misdemeanor the penalty for failing to file campaign reports, filing false reports, and filing false campaign finance complaints. Effective January 1, 1998. LRB9006921JMmbC LRB9006921JMmbC 1 AN ACT concerning campaign reform. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Election Code is amended by changing 5 Sections 9-11, 9-12, 9-13, 9-14, 9-26, and 9-28 and adding 6 Sections 9-2.5, 9-7.5, 9-8.5, 9-8.10, 9-8.15, 9-25.5, and 7 9-27.5 as follows: 8 (10 ILCS 5/9-2.5 new) 9 Sec. 9-2.5. Single political committee. 10 (a) No public official or candidate for public office 11 may establish more than one political committee for each 12 office that public official or candidate is seeking. 13 (b) The public officials elected President of the 14 Senate, Minority Leader of the Senate, Speaker of the House, 15 and Minority Leader of the House may each establish and 16 operate one additional political committee for the purpose of 17 supporting the election of candidates to the General 18 Assembly. The committees provided for in this subsection (b) 19 shall be considered established by the President of the 20 Senate, Minority Leader of the Senate, Speaker of the House, 21 and Minority Leader of the House for purposes of Section 22 9-8.5. 23 (c) No corporation, labor union, or association of 24 individuals, however described or organized, may establish, 25 singly or with others, more than one political committee. 26 (10 ILCS 5/9-7.5 new) 27 Sec. 9-7.5. Contributor registration and disclosure. 28 Any corporation, labor union, or association of individuals, 29 however described or organized, that spends more than $1,000 30 in money or the fair market value of its services, in the -2- LRB9006921JMmbC 1 aggregate and over any period of time, in support of or in 2 opposition to any one or more candidates for public office or 3 public questions shall register with the Board in a manner 4 prescribed by the Board and shall file financial disclosure 5 reports with the Board. The reports shall be filed at the 6 same times that campaign contribution and expenditure reports 7 are required of political committees and shall be for the 8 same reporting periods. The reports shall itemize all amounts 9 and recipients. The Board shall promulgate forms for the 10 reports. 11 (10 ILCS 5/9-8.5 new) 12 Sec. 9-8.5. Contribution and transfer limits. 13 (a) No individual may make contributions to the 14 political committees established by a candidate for public 15 office or public official of more than $1,500 during a 16 primary election period or of more than $1,500 during a 17 general election period. 18 (b) No corporation, labor union, or association of 19 individuals, however described or organized, that has not 20 established a political committee may make contributions to 21 the political committees established by a candidate for 22 public office or public official of more than $3,000 during a 23 primary election period or of more than $3,000 during a 24 general election period. 25 (c) No political committee established by a corporation, 26 labor union, or association of individuals, however described 27 or organized, may make contributions to the political 28 committees established by a candidate for public office or 29 public official of more than $5,000 during a primary election 30 period or of more than $5,000 during a general election 31 period. Nothing in this subsection (c) shall prohibit or 32 limit the amount of transfers by a political committee 33 established by a candidate for public office or public -3- LRB9006921JMmbC 1 official. 2 (d) For purposes of this Section, a primary election 3 period begins July 1 of an odd-numbered year and ends the day 4 of the next primary election. A general election period 5 begins the day after a primary election and ends June 30 of 6 the next odd-numbered year. 7 (e) The limitations established in this Section apply in 8 the aggregate to all political committees established by a 9 candidate for public office or public official. 10 (10 ILCS 5/9-8.10 new) 11 Sec. 9-8.10. Use of political committee funds. 12 (a) The funds of a political committee controlled by a 13 public official or by a candidate may be used only for: 14 (1) expenditures that would be treated as 15 deductions or exempt functions under Section 527 of the 16 Internal Revenue Code and the regulations promulgated 17 under that Section; 18 (2) defraying the ordinary and necessary expenses 19 of a public official; 20 (3) donations to organizations described in Section 21 170(c) of the Internal Revenue Code; or 22 (4) transfers to any national, State, or local 23 political committee, subject to the laws governing that 24 political committee. 25 (b) A political committee shall not make expenditures: 26 (1) in violation of any law of the United States or 27 of this State; 28 (2) clearly in excess of the fair market value of 29 the services, materials, facilities, or other things of 30 value received in exchange; 31 (3) for satisfaction or repayment of any debts 32 other than loans made to the committee or repayment of 33 goods and services purchased by the committee under a -4- LRB9006921JMmbC 1 credit agreement. The repayments shall be made by check 2 written to the person who made the loan or credit 3 agreement. The terms and conditions of any loan or 4 credit agreement to a committee shall be set forth in a 5 written agreement, including but not limited to the 6 method and amount of repayment, that shall be executed by 7 the chairman or treasurer of the committee at the time of 8 the loan or credit agreement. The loan or agreement 9 shall also set forth the rate of interest for the loan, 10 if any, which may not substantially exceed the prevailing 11 market interest rate at the time the agreement is 12 executed; 13 (4) for clothing or laundry expenses, except 14 clothing items rented by the candidate for his or her own 15 use exclusively for a specific campaign-related event, 16 provided that committees may purchase costumes, novelty 17 items, or other accessories worn primarily to advertise 18 the candidacy; 19 (5) for the travel expenses of a candidate, public 20 official, committee officer, campaign worker, staff 21 member, or a family member of any such person, to or from 22 a destination outside the State of Illinois, including 23 room, board, and entertainment expenses incurred outside 24 the State of Illinois, unless the travel is necessary for 25 fulfillment of political or governmental duties; 26 (6) for membership or club dues charged by 27 organizations, clubs, or facilities that are primarily 28 engaged in providing health, exercise, or recreational 29 services; provided, however, that funds received under 30 this Article may be used to rent the clubs or facilities 31 for a specific campaign-related event; 32 (7) in payment for anything of value or for 33 reimbursement of any expenditure for which any person has 34 been reimbursed by the State or any person; -5- LRB9006921JMmbC 1 (8) for the purchase of or installment payment for 2 a motor vehicle. A political committee may lease a motor 3 vehicle if the vehicle will be used primarily for 4 campaign purposes or for the performance of governmental 5 duties. A committee shall keep detailed records of the 6 use of any leased vehicle and shall not make expenditures 7 for use of the vehicle for non-campaign or 8 non-governmental purposes. Persons using vehicles not 9 leased by a political committee may be reimbursed for 10 actual mileage for the use of the vehicle for campaign 11 purposes or for the performance of governmental duties. 12 The mileage reimbursements shall be made at a rate not to 13 exceed the standard mileage rate method for computation 14 of business expenses under the Internal Revenue Code; or 15 (9) for purchase or lease of anything of value 16 owned by the candidate or by a corporation owned by, 17 managed by, or employing the candidate, unless the thing 18 of value is purchased or leased at its cost, without 19 profit to its owner. 20 (c) The Board shall have the authority to investigate, 21 upon its own motion or receipt of a complaint, violations of 22 the provisions of this Section. The Board may levy a fine on 23 any person who knowingly makes expenditures in violation of 24 this Section. The fine shall not exceed $500 for each 25 expenditure of $500 or less and shall not exceed the amount 26 of the expenditure plus $500 for each expenditure greater 27 than $500. The Board shall also have the authority to render 28 rulings and issue opinions relating to compliance with this 29 Section. 30 (d) For the purposes of this Section: 31 (1) "exempt function" has the same meaning as in 32 Section 527 of the Internal Revenue Code and the 33 regulations promulgated under that Section; 34 (2) "ordinary and necessary expenses of an elected -6- LRB9006921JMmbC 1 official" means expenses for which public funds may be 2 used; and 3 (3) "immediate family" means a candidate's or 4 public official's spouse, siblings, parents, and 5 children and the candidate's or public official's 6 spouse's siblings, parents, and children. 7 (10 ILCS 5/9-8.15 new) 8 Sec. 9-8.15. Contributions made on State property. 9 Contributions shall not be solicited, offered, or accepted on 10 State property. Contributions received on State property 11 shall be returned within 3 business days. 12 Anyone who knowingly solicits, offers, or accepts 13 contributions on State property is guilty of a Class A 14 misdemeanor. 15 (10 ILCS 5/9-11) (from Ch. 46, par. 9-11) 16 Sec. 9-11. Each report of campaign contributions under 17 Section 9-10 shall disclose- 18 (1) the name and address of the political committee; 19 (2) (Blank); 20 (3) the amount of funds on hand at the beginning of the 21 reporting period; 22 (4) the full name and mailing address of each person who 23 has made one or more contributions to or for such committee 24 within the reporting period in an aggregate amount or value 25 in excess of $150, together with the amount and date of such 26 contributions, and if the contributor is an individual, the 27 occupation and employer of the contributor; 28 (5) the total sum of individual contributions made to or 29 for such committee during the reporting period and not 30 reported under item (4); 31 (6) the name and address of each political committee 32 from which the reporting committee received, or to which that -7- LRB9006921JMmbC 1 committee made, any transfer of funds, in any aggregate 2 amount or value in excess of $150, together with the amounts 3 and dates of all transfers; 4 (7) the total sum of transfers made to or from such 5 committee during the reporting period and not reported under 6 item (6); 7 (8) each loan to or from any person within the reporting 8 period by or to such committee in an aggregate amount or 9 value in excess of $150, together with the full names and 10 mailing addresses of the lender and endorsers, if any, and 11 the date and amount of such loans, and if a lender or 12 endorser is an individual, the occupation and employer of 13 that individual; 14 (9) the total amount of proceeds received by such 15 committee from (a) the sale of tickets for each dinner, 16 luncheon, cocktail party, rally, and other fund-raising 17 events; (b) mass collections made at such events; and (c) 18 sales of items such as political campaign pins, buttons, 19 badges, flags, emblems, hats, banners, literature, and 20 similar materials; 21 (10) each contribution, rebate, refund, or other receipt 22 in excess of $150 received by such committee not otherwise 23 listed under items (4) through (9), and if the contributor is 24 an individual, the occupation and employer of the 25 contributor; 26 (11) the total sum of all receipts by or for such 27 committee or candidate during the reporting period. 28 The reports of campaign contributions filed under this 29 Article shall be cumulative during the reporting period to 30 which they relate. 31 (Source: P.A. 90-495, eff. 1-1-98.) 32 (10 ILCS 5/9-12) (from Ch. 46, par. 9-12) 33 Sec. 9-12. Dissolution of political committee. Each 26 public official who leaves office due to retirement or 27 defeat, and each candidate for public office who has been 28 defeated, must close his or her political committee and 29 surrender any remaining funds within one year after leaving 30 office or losing an election. In the case of the death of a 31 public official or candidate for public office, the officers 32 of the political committee must dissolve the political 33 committee within one year after the public official's or -16- LRB9006921JMmbC 1 candidate's death. 2 Upon the dissolution of a political committee, its 3 remaining funds shall be surrendered to the State Treasurer 4 for deposit into the Common School Fund. 5 (10 ILCS 5/9-26) (from Ch. 46, par. 9-26) 6 Sec. 9-26. Willful failure to file or willful filing of 7 false or incomplete information required by this Article 8 shall constitute a Class ABmisdemeanor. 9 Willful filing of a false complaint under this Article 10 shall constitute a Class ABmisdemeanor. 11 A prosecution for any offense designated by this Article 12 shall be commenced no later than 18 months after the 13 commission of the offense. 14 The appropriate State's Attorney or the Attorney General 15 shall bring such actions in the name of the people of the 16 State of Illinois. 17 (Source: P.A. 78-1183.) 18 (10 ILCS 5/9-27.5 new) 19 Sec. 9-27.5. Fundraising within Sangamon County. No 20 member of the General Assembly or candidate for that office 21 may hold a fundraising function within Sangamon County, 22 Illinois, during any calendar week (Sunday through Saturday) 23 in which the legislature is in session. 24 (10 ILCS 5/9-28) 25 Sec. 9-28. Electronic filing and availability. The Board 26 shallmayby rule provide for the optional electronic filing 27 of reports and statements under this Articleof expenditure28and contribution reports.
