90_HB2313 10 ILCS 5/9-25.3 new Amends the Election Code. Provides that no candidate or political committee shall accept cash contributions in excess of $150 from any person or entity during any calendar year. Provides that any contribution in excess of $150 shall be made by negotiable instrument or be evidenced by an itemized credit card receipt. Provides that a violation is a Class A misdemeanor. Provides that a person who is convicted of violating the limits shall be fined 3 times the amount of the contributions accepted in violation of the limits. Provides that a contribution accepted in violation of the limits shall escheat to the State of Illinois. Effective immediately. The Election Code is amended by adding 6 Section 9-25.3 as follows: 7 (10 ILCS 5/9-25.3 new) 8 Sec. 9-25.3. Cash contributions; limits. 9 (a) No candidate or political committee shall accept 10 cash contributions in excess of $150 from any person or 11 entity during any calendar year. 12 (b) Any contribution in excess of $150, other than 13 in-kind contributions, shall be made by negotiable instrument 14 or be evidenced by an itemized credit card receipt bearing on 15 its face the name of the remitter. 16 (c) For purposes of this Section, a cash contribution 17 shall be deemed to have been accepted if it is negotiated or 18 deposited, or if it is not returned to the contributor within 19 72 hours of receipt. 20 (d) A violation under this Section is a Class A 21 misdemeanor. In addition to any other penalty prescribed by 22 this Section, a person convicted under subsection (a) shall 23 be fined 3 times the amount of the contributions found to 24 have been accepted in violation this Section. 25 (e) Any contribution accepted in violation of this 26 Section shall escheat to the State of Illinois. 27 Section 99. Effective date. This Act takes effect upon 28 becoming law.
