Provides that an employer to whom this Act applies must pay an employee's net pay to the employee in the form of a check or other negotiable instrument made payable to the employee or by direct deposit into an employee's account in a financial institution. Provides that no employer may pay an employee's net pay to the employee in the form of currency. Provides that violation is a Class A misdemeanor. Exempts payments to workers who receive pay each day they work and payments to an employee whose weekly net pay is less than $100. The Illinois Wage Payment and Collection Act 6 is amended by adding Section 4.5 as follows: 7 (820 ILCS 115/4.5 new) 8 Sec. 4.5. Payment of wages in currency prohibited. 9 (a) An employer to whom this Act applies must pay an 10 employee's net pay to the employee in the form of a check or 11 other negotiable instrument made payable to the employee or 12 by direct deposit into an employee's account in a financial 13 institution. No employer may pay an employee's net pay to the 14 employee in the form of currency. 15 (b) Violation of this Section is a Class A misdemeanor. 16 (c) Nothing in this Section applies to the following: 17 (1) Payments to workers who receive pay each day 18 they work. 19 (2) Payments to an employee whose weekly net pay is 20 less than $100.
