Provides that on and after the effective date of this amendatory Act, the Sheriff of Cook County may, in his or her discretion and with the advice and consent of the county board, appoint additional members to the Cook County Sheriff's Merit Board (now limited to 5 members). Provides that as additional members are appointed, the political affiliation of the Board shall be such that no more than one-half of the members plus one additional member may be affiliated with the same political party. Provides that as additional members are appointed, at least 40% of the members must be present to constitute a quorum. Effective immediately. LRB9004899KDks LRB9004899KDks 1 AN ACT to amend the Counties Code by changing Sections 2 3-7002 and 3-7005. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Counties Code is amended by changing 6 Sections 3-7002 and 3-7005 as follows: 7 (55 ILCS 5/3-7002) (from Ch. 34, par. 3-7002) 8 Sec. 3-7002. Cook County Sheriff's Merit Board. There is 9 created the Cook County Sheriff's Merit Board, hereinafter 10 called the Board, consisting of 5 members appointed by the 11 Sheriff with the advice and consent of the county board, 12 except that on and after the effective date of this 13 amendatory Act of 1997, the Sheriff may appoint additional 14 members, with the advice and consent of the county board, at 15 his or her discretion. Of the members first appointed, one 16 shall serve until the third Monday in March, 1965 one until 17 the third Monday in March, 1967, and one until the third 18 Monday in March, 1969. Of the 2 additional members first 19 appointed under authority of this amendatory Act of 1991, one 20 shall serve until the third Monday in March, 1995, and one 21 until the third Monday in March, 1997. 22 Upon the expiration of the terms of office of those first 23 appointed (including the 2 additional members first appointed 24 under authority of this amendatory Act of 1991), their 25 respective successors shall be appointed to hold office from 26 the third Monday in March of the year of their respective 27 appointments for a term of 6 years and until their successors 28 are appointed and qualified for a like term. As additional 29 members are appointed under authority of this amendatory Act 30 of 1997, their terms shall be set to be staggered 31 consistently with the terms of the existing Board members. No -2- LRB9004899KDks 1 more than 3 members of the Board shall be affiliated with the 2 same political party, except that as additional members are 3 appointed by the sheriff under authority of this amendatory 4 Act of 1997, the political affiliation of the Board shall be 5 such that the no more than one-half of the members plus one 6 additional member may be affiliated with the same political 7 party. No, nor shall anymember shall have held or have 8 been a candidate for an elective public office within one 9 year preceding his or her appointment. 10 The Sheriff may deputize members of the Board. 11 (Source: P.A. 86-962; 86-1028; 87-534.) 12 (55 ILCS 5/3-7005) (from Ch. 34, par. 3-7005) 13 Sec. 3-7005. Meetings. As soon as practicable after the 14 members of the Board have been appointed, they shall meet, 15 upon the call of the Sheriff, and shall organize by selecting 16 a chairman and a secretary. The initial chairman and 17 secretary, and their successors, shall be selected by the 18 Board from among its members for a term of 2 years or for the 19 remainder of their term of office as a member of the Board, 20 whichever is the shorter. Two members of the Board shall 21 constitute a quorum for the transaction of business, except 22 that as additional members are appointed under authority of 23 this amendatory Act of 1997, the number of members that must 24 be present to constitute a quorum shall be the number of 25 members that constitute at least 40% of the Board. The Board 26 shall hold regular quarterly meetings and such other meetings 27 as may be called by the chairman. 28 (Source: P.A. 86-962.) 29 Section 99. Effective date. This Act takes effect upon 30 becoming law.
