The following 25 Act is repealed on January 1, 2008: 26 The Nursing Home Administrators Licensing and 27 Disciplinary Act. 28 The Physician Assistant Practice Act of 1987. 29 The Illinois Nursing Act of 1987. 30 The Marriage and Family Therapy Licensing Act."; and 31 on page 2, by deleting lines 1 through 21; and 32 on page 4, by replacing lines 16 and 17 with "Illinois may -3- LRB9003437DPmbam01 1 practice acupuncture."; and 2 on page 7, in line 17, by replacing "and" with "or"; and 3 on page 16, in line 1, by deleting the comma; and 4 on page 16, in line 13, by replacing "registration" with 5 "licenseregistration"; and 6 on page 23, in line 19, by replacing "20" with "140"; and 7 on page 44, in line 28, after "40,", by inserting "42,"; and 8 on page 67, in line 17, by replacing "(Blank)." with the 9 following: 10 "Conducting a survey, as prescribed by rule of the 11 Department, once every 4 years during the license renewal 12 period."; and 13 on page 70, in line 9, by replacing ".;" with ".;"; and 14 on page 85, in line 6, by replacing ";" with ".;"; and 15 on page 135, by deleting lines 3 through 32; and 16 by deleting all of pages 136 through 158; and 17 on page 159, by deleting lines 1 through 23; and 18 on page 159, immediately above line 24, by inserting the 19 following: 20 "Section 70. The Professional Geologist Licensing Act is 21 amended by changing Sections 25, 52, and 65 as follows: 22 (225 ILCS 745/25) 23 Sec. 25. Restrictions and limitations. No person shall, 24 without a valid license issued by the Department (i) in any 25 manner hold himself or herself out to the public as a 26 licensed professional geologist; (ii) attach the title -4- LRB9003437DPmbam01 1 "Licensed Professional Geologist" to his or her name; or 2 (iii) render or offer to render to individuals, corporations, 3 or public agencies services constituting the practice of 4 professional geology. 5 Individuals practicing geology in Illinois as of the 6 effective date of this amendatory Act of 1997 may continue to 7 practice as provided in this Act until the Department has 8 adopted rules implementing this Act. To continue practicing 9 geology after the adoption of rules, individuals shall apply 10 for licensure within 180 days after the effective date of the 11 rules. If an application is received during the 180-day 12 period, the individual may continue to practice until the 13 Department acts to grant or deny licensure. If an 14 application is not filed within the 180-day period, the 15 individual must cease the practice of geology at the 16 conclusion of the 180-day period and until the Department 17 acts to grant a license to the individual. 18 (Source: P.A. 89-366, eff. 7-1-96.) 19 (225 ILCS 745/52) 20 Sec. 52. Alternate qualification for licensure. The 21 Department may issue a license to practice professional 22 geology in Illinois to any applicant who, on or before July 23 1, 1998within one calendar year after the effective date of24this Act, meets the following qualifications: 25 (1) The applicant has completed an application form 26 and remitted the application fee. 27 (2) The applicant meets all of the requirements for 28 a license under subsection (a) of Section 50 excluding 29 the requirements for passing the required examination. 30 (Source: P.A. 89-366, eff. 7-1-96.) 31 (225 ILCS 745/65) 32 Sec. 65. Expiration and renewal of license. The -5- LRB9003437DPmbam01 1 expiration date and renewal period for each license shall be 2 set by rule. A professional geologist whose license has 3 expired may reinstate his or her license at any time within 5 4 years after the expiration thereof, by making a renewal 5 application and by paying the required fee. However, any 6 professional geologist whose license expired while he or she 7 was (i) on active duty with the Armed Forces of the United 8 States or called into service or training by the State 9 militia or (ii) in training or education under the 10 supervision of the United States preliminary to induction 11 into the military service, may have his professional 12 geologist license renewed, reinstated, or restored without 13 paying any lapsed renewal fees if within 2 years after 14 termination of the service, training, or education the 15 professional geologist furnishes the Department with 16 satisfactory evidence of service, training, or education and 17 it has been terminated under honorable conditions. 18 Any professional geologist whose license has expired for 19 more than 5 years may have it restored by making application 20 to the Department, paying the required fee, and filing 21 acceptable proof of fitness to have the license restored. The 22 proof may include sworn evidence certifying active practice 23 in another jurisdiction. If the geologist has not practiced 24 for 5 years or more, the Board shall determine by an 25 evaluation program established by rule, whether that 26 individual is fit to resume active status and may require the 27 professional geologist to complete a period of evaluated 28 professionalclinicalexperience and may require successful 29 completion of an examination. 30 The Department may refuse to issue or may suspend the 31 license of any person who fails to file a return, or to pay 32 the tax, penalty or interest shown in a filed return, or to 33 pay any final assessment of tax, penalty, or interest, as 34 required by any tax Act administered by the Illinois -6- LRB9003437DPmbam01 1 Department of Revenue, until such time as the requirements of 2 any such tax Act are satisfied. 3 (Source: P.A. 89-366, eff. 7-1-96.)".
