Provides that the occupation and employer of a person making a campaign contribution be reported. Provides that information about a person contributing $150 or more in a calendar year (now $150 in the reporting period) be reported. Provides that the State Board of Elections shall make campaign contribution and expenditure reports available in an electronic form. Provides that candidates shall not use campaign contributions for personal uses. Provides that a candidate may not accept more contributions from contributors not within his or her district than from contributors within his or her district. Provides that a candidate shall not accept contributions from foreign nationals or public utilities regulated by the Illinois Commerce Commission or by any other State agency. Deletes a provision that persons examining campaign contributions and expenditures must provide personal information. Amends the Lobbyist Registration Act. Provides that a person who has held certain offices or who has been employed by the General Assembly or a member of the General Assembly shall not lobby for a period of one year after leaving his or her office or employment. LRB9004537MWpc LRB9004537MWpc 1 AN ACT concerning campaign finance, amending named Acts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Election Code is amended by changing 5 Sections 9-2, 9-11, 9-12, 9-13, 9-14, and 9-17 and adding 6 sections 9-1.15, 9-1.20, 9-25.3, 9-25.5, 9-25.7, and 9-28 as 7 follows: 8 (10 ILCS 5/9-1.15 new) 9 Sec. 9-1.15. Person within the district. "Person within 10 the district" means an individual who resides in, or a 11 business with its principal place of business located within, 12 the district in which the candidate is seeking office. A 13 "person within the district" does not include family members 14 within the district, corporations, trusts, labor 15 organizations, or political committees. 16 (10 ILCS 5/9-1.20 new) 17 Sec. 9-1.20. Family member within the district. "Family 18 member within the district" means a candidate or a 19 candidate's spouse, parent, grandparent, child, grandchild, 20 aunt, uncle, niece, nephew, brother, sister, first cousin, 21 brother-in-law, sister-in-law, mother-in-law, father-in-law, 22 son-in-law, or daughter-in-law residing within the district. 23 (10 ILCS 5/9-2) (from Ch. 46, par. 9-2) 24 Sec. 9-2. Every political committee shall designate a 25 chairman and a treasurer. The same person may serve as both 26 chairman and treasurer of any political committee. A 27 candidate who administers his own campaign contributions and 28 expenditures shall be deemed a political committee for 29 purposes of this Article and shall designate himself as -2- LRB9004537MWpc 1 chairman, treasurer, or both chairman and treasurer of such 2 political committee. The treasurer of a political committee 3 shall be responsible for keeping the records and filing the 4 statements and reports required by this Article. 5 No contribution and no expenditure shall be accepted or 6 made by or on behalf of a political committee at a time when 7 there is a vacancy in the office of chairman or treasurer 8 thereof. No expenditure shall be made for or on behalf of a 9 political committee without the authorization of its chairman 10 or treasurer, or their designated agents. 11 A political committee may apply the funds received under 12 this Article only against expenditures for personnel, 13 services, materials, facilities, or other things of value 14 purchased to further a candidate's nomination or election to 15 office, or for expenses accrued in the performance of 16 governmental duties. 17 A political committee shall not make expenditures: 18 (1) In violation of any law of the United States or 19 of this State. 20 (2) Clearly in excess of the fair market value of 21 the services, materials, facilities, or other things of 22 value received in exchange. 23 (3) For satisfaction of personal debts, other than 24 repayment of loans to the campaign. Those repayments 25 shall be made by check written to the person who made the 26 loan. If the repayment is for a loan made by the 27 candidate to the committee, the repayment shall not 28 include interest exceeding the prevailing prime interest 29 rate. 30 (4) In payment for items, services, or benefits for 31 the candidate, elected official, committee officer, or 32 his or her family, unless for reimbursement of campaign 33 expenses or expenses related to the performance of 34 governmental duties. -3- LRB9004537MWpc 1 (5) For clothing or laundry expenses, except 2 clothing items rented by a candidate for his or her use 3 exclusively for a specific campaign-related event. 4 (6) For travel expenses for a candidate, public 5 official, campaign worker, staff member, committee 6 officer, or family member to or from a destination 7 outside the State of Illinois, including room, board, and 8 entertainment expenses incurred outside the State of 9 Illinois. 10 (7) For membership or club dues charged by 11 organizations, clubs, or facilities that are primarily 12 engaged in providing health, exercise, or recreational 13 services. However, campaign funds may be used to rent 14 those clubs or facilities for a specific campaign-related 15 meeting or fundraising event. 16 (8) In payment for any item, service, or 17 expenditure for which any individual has been reimbursed, 18 or will be reimbursed, by the State or party, or other 19 person or institution. 20 (9) For the purchase of or installment payments for 21 a motor vehicle, unless its primary use is for 22 governmental or political purposes. Governmental or 23 political purposes include, without limitation, a 24 candidate or public official purchasing or leasing a 25 motor vehicle during the duration of the campaign if the 26 vehicle will be primarily used for governmental or 27 political purposes. Costs for other usage of the vehicle 28 shall not be paid from campaign funds. Candidates and 29 campaign workers using vehicles other than those 30 purchased or leased by a political committee may be 31 reimbursed for actual mileage for campaign-related travel 32 at a rate not to exceed the current rate of reimbursement 33 allowed under the standard mileage rate method for 34 computation of business expenses under the Internal -4- LRB9004537MWpc 1 Revenue Code. 2 (10) For purchase or lease of any equipment owned 3 by the candidate or by a corporation owned by, managed 4 by, or employing the candidate, unless the equipment is 5 purchased or leased at cost, without profit to the owner 6 of the equipment. 7 (11) For salaries or recompensation for lost income 8 to candidates. However, a candidate may receive a salary 9 or stipend of up to $3,000 per month from the campaign to 10 cover personal living expenses for any period of time in 11 which he or she is a designated candidate in a primary or 12 general election and is not currently receiving a salary 13 from the State or any unit of local government or any 14 other entity. The salary or stipend shall cease at the 15 end of the month that the candidate loses the election or 16 upon the swearing into office of the candidate or upon 17 establishment of another source of income. 18 The State Board of Elections shall have the authority to 19 investigate, upon its own motion or receipt of a complaint, 20 violations of the provisions of this Section. The Board may 21 levy a fine on any person who knowingly makes expenditures in 22 violation of this Section. The fine shall not exceed $500 23 for those expenditures that total $500 or less, and shall not 24 exceed the amount of the expenditure plus $500 for those 25 expenditures that total more than $500. The Board shall also 26 have the authority to render rulings and opinions in relation 27 to compliance with this Section. 28 (Source: P.A. 80-756.) 29 (10 ILCS 5/9-11) (from Ch. 46, par. 9-11) 30 Sec. 9-11. Each report of campaign contributions under 31 Section 9-10 shall disclose- 32 (1) the name and address of the political committee; 33 (2) the scope, area of activity, party affiliation, -5- LRB9004537MWpc 1 candidate affiliation, and purposes of the political 2 committee; 3 (3) the amount of funds on hand at the beginning of the 4 reporting period; 5 (4) in separate contributor categories for family 6 members within the district, persons within the district, 7 persons not within the district, and corporations, trusts, 8 and labor organizations, the full name and mailing address of 9 each contributor ofperson who has madeone or more 10 contributions to or for such committee within the calendar 11 yearreporting periodin an aggregate amount or value in 12 excess of $150, together with the amount and date of such 13 contributions, and if the contributor is an individual, the 14 occupation and employer of the contributor; 15 (5) the total sum of individual contributions made to or 16 for such committee during the reporting period and not 17 reported under item (4); 18 (6) the name and address of each political committee 19 from which the reporting committee received, or to which that 20 committee made, any transfer of funds, in any aggregate 21 amount or value in excess of $150 in the calendar year, 22 together with the amounts and dates of all transfers; 23 (7) the total sum of transfers made to or from such 24 committee during the reporting period and not reported under 25 item (6); 26 (8) each loan to or from any person within the calendar 27 yearreporting periodby or to such committee in an aggregate 28 amount or value in excess of $150, together with the full 29 names and mailing addresses of the lender and endorsers, if 30 any, and the date and amount of such loans, and if a lender 31 or endorser is an individual, the occupation and employer of 32 that individual; 33 (9) the total amount of proceeds received by such 34 committee from (a) the sale of tickets for each dinner, -6- LRB9004537MWpc 1 luncheon, cocktail party, rally, and other fund-raising 2 events; (b) mass collections made at such events; and (c) 3 sales of items such as political campaign pins, buttons, 4 badges, flags, emblems, hats, banners, literature, and 5 similar materials; 6 (10) each contribution, rebate, refund, or other receipt 7 in excess of $150 in the calendar year received by such 8 committee not otherwise listed under items (4) through (9), 9 and if the contributor is an individual, the occupation and 10 employer of the contributor; 11 (11) the total sum of all receipts by or for such 12 committee or candidate during the reporting period. 13 The reports of campaign contributions filed under this 14 Article shall be cumulative during the reporting period to 15 which they relate, but where there has been no change in an 16 item reported in a previous report during such year, only the 17 amount need be carried forward. 18 (Source: P.A. 86-873.) 19 (10 ILCS 5/9-12) (from Ch. 46, par. 9-12) 20 Sec. 9-12. All statements and reports filed under this 32 Article with the board or county clerk shall be available for 33 examination and copying by the public at all reasonable -15- LRB9004537MWpc 1 times.Such person examining a statement or report must first2fill out a form prepared by the Board identifying the3examiner by name, occupation, address and telephone number,4and listing the date of examination and reason for such5examination. The board shall supply such forms to the county6clerks annually and replenish such forms upon request.7The Board or county clerk, as the case may be, shall8promptly notify each political committee required to file a9statement or report under this Article of each instance of an10examination of its statement or report by sending it a11duplicate original of the identification form filled out by12the person examining its report.13 Any person who alters or falsifies information on a copy 14 of a statement or report obtained from the State Board of 15 Elections or the county clerk pursuant to Article 9 of this 16 Code and publishes, circulates or distributes such altered or 17 falsified information with the intent to misrepresent 18 contributions received or expenditures made by a candidate or 19 political committee shall be guilty of a Class B misdemeanor. 20 Any person who shall sell or utilize information copied 21 from statements and reports filed with the State Board of 22 Elections or the county clerk pursuant to Article 9 of this 23 Code for the purpose of soliciting contributions or for the 24 purpose of business solicitation shall be guilty of a Class B 25 misdemeanor. 26 (Source: P.A. 81-310.) 27 (10 ILCS 5/9-25.3 new) 28 Sec. 9-25.3. Contributions from foreign nationals 29 prohibited. No candidate or political committee shall 30 accept, either directly or indirectly, a contribution made by 31 a foreign national. For purposes of this Section, "foreign 32 national" means (i) an individual who is not a citizen of the 33 United States and who is not lawfully admitted for permanent -16- LRB9004537MWpc 1 residence, as defined by Section 101(a)(20) of the 2 Immigration and Nationality Act; (ii) a government of a 3 foreign country or a foreign political party; (iii) a person 4 outside of the United States, unless it is established that 5 the person is an individual and a citizen of and domiciled 6 within the United States, or that the person is not an 7 individual and is organized under or created by the laws of 8 the United States, this State, any other state, or any other 9 place subject to the jurisdiction of the United States and 10 has its principal place of business within the United States; 11 and (iv) a partnership, association, corporation, 12 organization, or other combination of persons organized under 13 the laws of or having its principal place of business in a 14 foreign country. "Foreign national" does not include any 15 individual who is a citizen of the United States. 16 (10 ILCS 5/9-25.5 new) 17 Sec. 9-25.5. Contributions from persons not within the 18 district; limit. At any time during a campaign contribution 19 reporting period prescribed in Section 9-10, a candidate may 20 not accept contributions from corporations, trusts, labor 21 organizations, persons not within the district, and political 22 committees in an aggregate amount that exceeds the aggregate 23 amount of contributors that the candidate has received during 24 the same reporting period from persons within the district. 25 (10 ILCS 5/9-25.7 new) 26 Sec. 9-25.7. Contributions from public utilities 27 prohibited. No candidate or political committee shall accept 28 contributions from any public utility regulated by the 29 Illinois Commerce Commission or by any other State agency. 30 (10 ILCS 5/9-28 new) 31 Sec. 9-28. Electronic filing. All reports of campaign -17- LRB9004537MWpc 1 contributions or expenditures filed by a candidate or a 2 political committee shall be filed in an electronic format 3 specified by the Board by rule. The Board shall determine by 4 rule whether electronic report filings shall be in lieu of or 5 in addition to the other filings of reports of campaign 6 contributions or expenditures required under this Article. 7 The Board shall promptly make all reports filed 8 electronically under this Section publicly accessible through 9 the World Wide Web. 10 Section 10. The Lobbyist Registration Act is amended by 11 adding Section 2.1 as follows: 12 (25 ILCS 170/2.1 new) 13 Sec. 2.1 Persons prohibited from lobbying. No person 14 who has served as a member of the General Assembly or as 15 Governor, Lieutenant Governor, Attorney General, Secretary of 16 State, State Comptroller, State Treasurer, Director or 17 Secretary of any State agency, or has served on any State 18 regulatory board or commission, and no person who has been 19 employed by the General Assembly or a member of the General 20 Assembly and has earned more than $50,000 annually shall 21 lobby under this Act for a period of one year after leaving 22 his or her office or employment. 23 Section 99. Effective date. This Act takes effect upon 24 becoming law.
