90_HB2219 35 ILCS 5/211 new Amends the Illinois Income Tax Act. Creates an income tax credit, beginning in taxable years beginning on or after January 1, 1997 and ending with taxable years ending on or before December 30, 2002, for an owner of a riparian filter strip in an amount equal to 5% of the property tax that the owner paid on the riparian strip during the taxable year. LRB9004938DPmg LRB9004938DPmg 1 AN ACT to amend the Illinois Income Tax Act by adding 2 Section 211. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Income Tax Act is amended by 6 adding Section 211 as follows: 7 (35 ILCS 5/211 new) 8 Sec. 211. Riparian filter strip tax credit. 9 (a) Beginning with taxable years beginning on or after 10 January 1, 1997 and ending with taxable years ending on or 11 before December 30, 2002, the owner of a riparian filter 12 strip shall be entitled to a tax credit against the tax 13 imposed in subsections (a) and (b) of Section 201 in an 14 amount equal to 5% of the property tax paid on the riparian 15 strip during the taxable year. 16 (b) For purposes of this Section, "riparian filter 17 strip" means a tract of land that (i) is between 10 feet and 18 66 feet in width, (ii) is located next to a waterway, 19 including but not limited to surface water, a stream, a 20 river, or a tributary, and (iii) contains vegetation that (A) 21 has a dense top growth, (B) forms a uniform ground cover, 22 and (C) has a heavy fibrous root. 23 (c) The county's soil and water conservation district 24 shall assist the taxpayer in completing a uniform certified 25 document as prescribed by the Department of Revenue in 26 cooperation with the Association of Illinois Soil and Water 27 Conservation Districts that certifies (i) that the property 28 meets the requirements established under this Section for 29 riparian filter strips and (ii) the acreage or square footage 30 of property that qualifies for the tax credit as a riparian 31 filter strip. The document shall be filed by the applicant -2- LRB9004938DPmg 1 with the Department. The Department shall adopt rules 2 concerning the filing of the document. The soil and water 3 conservation district shall create a conservation plan for 4 the creation of the filter strip. The plan shall be kept on 5 file in the soil and water conservation district office.
