 1                    AMENDMENT TO HOUSE BILL 2059
 2        AMENDMENT NO.     .  Amend House Bill 2059  by  replacing
 3    everything after the enacting clause with the following:
 4        "Section  5.   The  Department  of  Human Services Act is
 5    amended by adding Section 10-30 as follows:
 6        (20 ILCS 1305/10-30 new)
 7        Sec.  10-30.  Revolving  loan  program  to  maintain  and
 8    improve not-for-profit organizations' facilities.
 9        (a)  The  Department  shall,  subject  to  appropriation,
10    contract with a qualified statewide not-for-profit  community
11    development  financial  institution  to establish a revolving
12    loan  program  for  the   purpose   of   assisting   Illinois
13    not-for-profit  organizations  that  qualify  as exempt under
14    Section 501(c)(3) of  the  Internal  Revenue  Code  and  have
15    purchase  of service contracts with the State to maintain and
16    improve   their   facilities.     A    qualified    statewide
17    not-for-profit community development financial institution is
18    one  that has been in existence for at least 7 years prior to
19    the effective date of this amendatory Act  of  1997  and  has
20    assets in excess of $25,000,000.
21        (b)  The   revolving  loan  program  established  by  the
22    community  development  financial  institution  shall  be   a

 1    statewide  program.   Equal  consideration  shall be given to
 2    loan applications throughout the State.   Before  making  any
 3    loans   under  the  revolving  loan  program,  the  community
 4    development financial institution shall  develop  a  plan  to
 5    seek out qualified loan applications throughout the State.
 6        (c)  The contract shall require all of the following:
 7             (1)  All  principal  shall  be used by the statewide
 8        not-for-profit    community     development     financial
 9        institution  to  make  loans  to qualifying borrowers, to
10        serve as collateral for borrowers, and to leverage  other
11        private funds.
12             (2)  A   Department  representative  chosen  by  the
13        Secretary  of  Human  Services   shall   participate   in
14        screening applicants.
15             (3)  Repaid  principal  shall  be  used for the same
16        purpose as provided in item (1) of this subsection (c).
17        (d)  This revolving loan program shall be  used  for  the
18    following purposes:
19             (1)  To    assist    not-for-profit    organizations
20        identified  in  subsection (a) of this Section in meeting
21        regulatory standards.
22             (2)  To    enable    not-for-profit    organizations
23        identified in subsection (a) of this  Section  to  comply
24        with the Americans with Disabilities Act.
25             (3)  To    enable    not-for-profit    organizations
26        identified  in  subsection  (a) of this Section to remove
27        lead and asbestos from their buildings.
28             (4)  To   encourage   not-for-profit   organizations
29        identified  in  subsection  (a)  of   this   Section   to
30        voluntarily make capital improvements for the purposes of
31        maintenance,   repair  and  replacement,  and  preventive
32        maintenance of their facilities, such as improvements  to
33        heating   and   cooling   systems  and  structural  items
34        necessary to comply with applicable building codes.

 1        Section 99.  Effective date.  This Act takes effect  July
 2    1, 1997.".
