90_HB2033 605 ILCS 10/36 new 605 ILCS 10/37 new Amends the Toll Highway Act to require the Illinois State Toll Highway Authority to reimburse the Department of Transportation for all costs and administrative overhead associated with the development, planning, promotion, construction, land acquisition, contracting, and other improvements incurred on behalf of the Authority. Requires the Authority to comply with the same eminent domain requirements as other State agencies. LRB9004497NTsbA LRB9004497NTsbA 1 AN ACT to amend the Toll Highway Act by adding Sections 2 36 and 37. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Toll Highway Act is amended by adding 6 Sections 36 and 37 as follows: 7 (605 ILCS 10/36 new) 8 Sec. 36. Reimbursement. 9 (a) The Authority shall reimburse the Department of 10 Transportation for all costs and administrative overhead 11 associated with the development, planning, promotion, 12 construction, land acquisition, contracting, and other 13 improvements, or any combination of any of these, incurred on 14 behalf of the Authority. These costs include, but are not 15 limited to the following: 16 (1) Land acquisition. 17 (2) Public relations. 18 (3) Studies and analyses. 19 (4) Regulatory compliance. 20 (5) Consulting fees. 21 (6) Surveying. 22 (7) Engineering. 23 (b) A reimbursement shall occur before a land title or 24 deed is transferred or land is leased from the Department of 25 Transportation, unless the transfer or leasing has taken 26 place before the effective date of this amendatory Act of 27 1997, in which case the reimbursement shall take place within 28 one year from the effective date of this amendatory Act of 29 1997. 30 (c) In the case of public relations, study and analysis, 31 consulting fee, surveying, or engineering costs for projects -2- LRB9004497NTsbA 1 promulgated explicitly on behalf or request of the Authority, 2 the Authority shall fully reimburse the Department of 3 Transportation for expenses within 60 days of the date these 4 expenses are incurred. 5 (d) This Section applies to all toll highways not 6 completed before the effective date of this amendatory Act of 7 1997. 8 (605 ILCS 10/37 new) 9 Sec. 37. Eminent domain requirements. The Authority 10 shall comply with the same eminent domain requirements as 11 other State agencies.
