Amends the Toll Highway Act. Requires the Illinois State
Toll Highway Authority to comply with the State and federal
Environmental Protection Acts, the Illinois Endangered
Species Protection Act, and the Interagency Wetland Policy
Act of 1989. Requires the Authority to install sound
barriers along certain parts of toll highways. Provides that
new toll highways must be incorporated and planned in
accordance with a regional transportation plan of a
metropolitan transit agency.

1 AN ACT to amend the Toll Highway Act by adding Sections
2 36, 37, and 38.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Toll Highway Act is amended by adding
6 Sections 36, 37, and 38 as follows:
7 (605 ILCS 10/36 new)
8 Sec. 36. Compliance with other Acts. The Authority
9 shall comply with the State Environmental Protection Act, the
10 federal Environmental Protection Act, the Illinois Endangered
11 Species Protection Act, and the Interagency Wetland Policy
12 Act of 1989 and all rules promulgated under these Acts.

14 Sec. 37. Installation of sound barriers. The Authority
15 shall install sound barriers along those parts of toll
16 highways that are adjacent to residential areas if the
17 station for the collection of tolls or charges located in
18 that area generates enough revenue to be able to finance the
19 installation of the sound barriers. Nothing in this Section
20 shall be construed to prevent the Authority from installing
21 sound barriers in any other location.

23 Sec. 38. Regional transportation plan. Toll highways
24 constructed after the effective date of this amendatory Act
25 of 1997 must be incorporated and planned in accordance with
26 any current regional transportation plan of a metropolitan
27 transit agency, if a metropolitan transit agency exists where
28 the toll highway is to be constructed.
