Provides for the creation of job training programs throughout the State operated under the auspices of the public community colleges. Provides that the Act does not apply to or affect any existing apprenticeship program and is not intended to authorize job training in the public community colleges for any occupation or skill for which training is provided through an apprenticeship program. Provides that all costs of a job training program are to be shared equally by the State and the participating business. Establishes an Advisory Committee on Job Training, consisting of 9 members appointed by the Governor. Provides that the board of a community college district, in consultation with the Advisory Committee, shall develop an application form for businesses that wish to participate in the program. Specifies the minimum data that a completed application must furnish. Provides that the Advisory Committee shall initially evaluate each application and recommend it, favorably or unfavorably, to the board of the community college district, which has the power to make the final decision on a recommendation made by the Advisory Committee. Establishes criteria to be applied by the Advisory Committee and community college board in acting on applications. Requires the Advisory Committee to evaluate and make recommendations on applications in a manner that ensures that State funds appropriated to implement job training programs are being allocated to all regions of the State. Effective January 1, 1998. LRB9005364THcw LRB9005364THcw 1 AN ACT relating to job training programs, amending a 2 named Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Community College Act is amended 6 by adding Article IX as follows: 7 (110 ILCS 805/Art. IX heading new) 8 ARTICLE IX. JOB TRAINING PROGRAMS 9 (110 ILCS 805/9-1 new) 10 Sec. 9-1. Declaration of Policy. The public community 11 colleges, because of their local orientation and skilled 12 faculties, are uniquely qualified to conduct job training 13 initiatives. It is the intention of the General Assembly to 14 establish job training programs throughout the State, 15 operated under the auspices of the public community colleges, 16 whose costs are equally shared by the State of Illinois and 17 participating businesses. The purpose of these job training 18 programs is to improve the education, skill levels, and 19 productivity of employees and prospective employees of 20 businesses planning to newly locate or expand their 21 operations in Illinois. To ensure that these job training 22 programs operate effectively and fairly, it is desirable to 23 establish a permanent forum where representatives of 24 business, labor, and the community colleges can engage in 25 discussion and offer advice to the Board. It is not the 26 intent of this Act to interfere with or affect the operation 27 of any existing apprenticeship program, nor to authorize job 28 training in the public community colleges for any occupation 29 or skill for which training is provided in Illinois through 30 an apprenticeship program. -2- LRB9005364THcw 1 (110 ILCS 805/9-2 new) 2 Sec. 9-2. Creation of Advisory Committee. There is 3 created an Advisory Committee on Job Training, consisting of 4 9 members. The Governor shall appoint the members of the 5 Advisory Committee. Three members of the Advisory Committee 6 shall represent Illinois businesses, at least one of whom 7 shall represent small businesses. Three members of the 8 Advisory Committee shall represent labor, and 3 members shall 9 represent the individual, public community colleges. All 10 Advisory Committee members shall serve 4-year terms. The 11 terms of all of the initially-appointed Advisory Committee 12 members shall commence on January 1, 1998. The terms of one 13 business, labor and community college representative each 14 shall expire on January 1, 2000, January 1, 2001, and January 15 1, 2002. Thereafter, the terms of all Advisory Committee 16 members shall be 4 years. In case of a vacancy on the 17 Advisory Committee, the Governor shall appoint a replacement 18 for the remainder of the vacant term. Advisory Committee 19 members shall receive no compensation, except they shall be 20 reimbursed for their actual and necessary expenses incurred 21 as Advisory Committee members. 22 (110 ILCS 805/9-3 new) 23 Sec. 9-3. Application Procedure. The Board, in 24 consultation with the Advisory Committee, shall develop an 25 application form for businesses wishing to participate in a 26 job training program under this Article. The application 27 form shall specify that all costs of job training shall be 28 shared equally by the State and the participating business. 29 The application shall, at a minimum, require a business to 30 provide the following information: 31 (1) The name of the business and its form of 32 ownership; 33 (2) The most recent, audited statement of its -3- LRB9005364THcw 1 financial accounts; 2 (3) A full description of the business' plans to 3 locate or expand its operations in Illinois, including 4 the exact geographic location of the business creation or 5 expansion, the products to be produced or services 6 provided, and the number and types of jobs expected to be 7 created; 8 (4) An explanation of how the job training program 9 requested by the business will improve worker skills and 10 business productivity; and 11 (5) Any additional information which the Board or 12 Advisory Committee may require. 13 (110 ILCS 805/9-4 new) 14 Sec. 9-4. Evaluation of Applications. All applications 15 submitted by businesses under this Article shall initially be 16 submitted to the Advisory Committee. The Advisory Committee 17 shall recommend each application either favorably or 18 unfavorably. The recommendation shall be based on the 19 contents of the application, as well as any additional 20 investigations or interviews conducted by the Advisory 21 Committee. 22 The factors which the Advisory Committee shall consider 23 in evaluating each application shall include, but not be 24 limited to, the following: 25 (1) The ability of local community colleges to 26 effectively provide the requested training; 27 (2) The probability that the business will succeed 28 in successfully developing its business operations 29 according to plan; 30 (3) The probability that the business will succeed 31 in developing the needed workforce in the locality 32 selected for business expansion or creation; 33 (4) The projected impact of the job training -4- LRB9005364THcw 1 program on job creation and business productivity; 2 (5) Whether the types of skills created by the job 3 training program are consistent with the overall economic 4 developments of the region; 5 (6) The projected costs to the local community 6 colleges; and 7 (7) The total money available to the Board for job 8 training programs under this Article. 9 The Advisory Committee shall not evaluate applications 10 submitted by businesses on an absolute basis, but rather 11 shall compare the projected benefits and costs that would 12 result from the granting of an application in comparison to 13 the projected benefits and costs of other applications the 14 Advisory Committee is evaluating. The Advisory Committee 15 shall evaluate and make its recommendations on applications 16 in a manner that ensures that State funds appropriated to 17 implement this Article are being allocated to all regions in 18 the State. The Advisory Committee shall not favorably 19 recommend any application for training in an occupation or 20 skill for which training is provided in Illinois through an 21 apprenticeship program. 22 (110 ILCS 805/9-5 new) 23 Sec. 9-5. State Board Approval. All recommendations of 24 the Advisory Committee under this Article are subject to the 25 final approval of the Board. In making its final decisions 26 on each application, the Board shall be guided by the same 27 criteria as the criteria that are set forth in Section 9-4. 28 In arriving at its final decisions, the Board may freely 29 consult with the Advisory Committee. The Board shall not 30 approve any application for training in an occupation or 31 skill for which training is provided in Illinois through an 32 apprenticeship program. -5- LRB9005364THcw 1 Section 99. Effective date. This Act takes effect 2 January 1, 1998.
