      305 ILCS 5/12-4.32 new
          Amends the Act on the Aging  and  the  Public  Aid  Code.
      Authorizes  the Department of Public Aid to establish 3 pilot
      programs, which may be  administered  by  the  Department  on
      Aging  as  permitted by available appropriations, designed to
      reduce the need of persons age 75 and older for nursing  home
      care  on  account  of  falls  or  other  injuries.  Effective
      immediately.

 1        AN ACT concerning health, amending named Acts.
 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:
 4        Section  5.  The  Illinois Act on the Aging is amended by
 5    adding Section 4.02c as follows:
 6        (20 ILCS 105/4.02c new)
 7        Sec.  4.02c.  Medical  intervention  for  frail  elderly;
 8    pilot programs.  Pursuant to interagency  agreement,  and  as
 9    permitted  by  available  appropriations,  the Department may
10    administer the pilot programs for  medical  intervention  for
11    frail elderly persons established by the Department of Public
12    Aid  under  Section  12-4.32 of the Illinois Public Aid Code.
13    In administering the pilot  programs,  the  Department  shall
14    work  with  agencies  or health care providers capable of (i)
15    providing the variety of services required  by  the  programs
16    and (ii) cooperating in designing a data collection mechanism
17    to  determine  whether  the  pilot programs are successful in
18    achieving the goal of reducing the need of persons  75  years
19    of age and older for nursing home care on account of falls or
20    other  injuries.   In  administering  the pilot programs, the
21    Department need not establish contemporaneous control groups,
22    but may use retroactive data to determine whether  there  has
23    been  a reduction in the need for nursing home care among the
24    target population.
25        Section 10.  The Illinois Public Aid Code is  amended  by
26    adding Section 12-4.32 as follows:

28        Sec.  12-4.32.  Medical  intervention  for frail elderly;

 1        (a)  The Illinois Department may establish pilot programs
 2    designed to reduce the need of persons 75 years  of  age  and
 3    older  for  nursing  home  care  on account of falls or other
 4    injuries.  The programs, if implemented, shall provide direct
 5    intervention  in  the  form  of  health  care  services   for
 6    individuals  after  a  physical  examination  by  a physician
 7    licensed to practice medicine in all its branches  to  assess
 8    the  individual's  current  health  status  and treatment for
 9    conditions causing dizziness or instability in walking. These
10    health  care   services   may   include   physical   therapy,
11    occupational  therapy,  and  medically recommended equipment,
12    supplies, and changes in the individual's home environment.
13        (b)  The Illinois Department shall  establish,  by  rule,
14    eligibility criteria for participation in the pilot programs.
15        (c)  The Illinois Department may establish pilot programs
16    under  this Section in the following 3 locations: a city with
17    more than 1,000,000 inhabitants;  a  county  with  more  than
18    750,000  but  fewer  than 3,000,000 inhabitants; and a county
19    that has fewer than 500,000 inhabitants and is not contiguous
20    with a county that has more than 3,000,000 inhabitants.
21        (d)  The Illinois Department shall apply for all  waivers
22    of  federal  law  and  regulations necessary to implement the
23    pilot  programs  under  this  Section,  including  provisions
24    concerning  comparability,   statewideness,   and   financial
25    eligibility.
26        Section  99.  Effective date.  This Act takes effect upon
27    becoming law.
