Provides that a public body may require a contractor that is the successful bidder on a public works project and its subcontractors to enter into or agree to observe the terms of a project labor agreement establishing the terms and conditions of employment for workers subject to this Act with the labor organization having jurisdiction over the type of work performed. Provides that a project labor agreement requirement shall not be deemed contrary to the requirement that a bid be let to the lowest responsible bidder. LRB9005194WHmg HB1843 Engrossed LRB9005194WHmg 1 AN ACT to amend the Prevailing Wage Act by adding Section 2 11c. 3 WHEREAS, Project labor agreements promote labor peace, 4 stability, and uninterrupted performance in the construction 5 of public works subject to the Prevailing Wage Act, and 6 promote the policies of the Prevailing Wage Act to maintain 7 prevailing rates on public works; therefore 8 Be it enacted by the People of the State of Illinois, 9 represented in the General Assembly: 10 Section 5. The Prevailing Wage Act is amended by adding 11 Section 11c as follows: 12 (820 ILCS 130/11c new) 13 Sec. 11c. Project labor agreements permitted. No 14 provision of this Act, nor of any other Act providing for the 15 competitive bidding of contracts for the construction of 16 public works subject to this Act, shall be construed to 17 prohibit a public body subject to this Act, acting in its 18 capacity as a project proprietor, manager, or purchaser of 19 construction services, to require the contractor that is the 20 successful bidder on a public works project subject to this 21 Act and its subcontractors, as a condition for performing the 22 work called for in the contract, to enter into or agree to 23 observe the terms of a project labor agreement establishing 24 the terms and conditions of employment for laborers, 25 mechanics, or workers subject to this Act with the labor 26 organization having jurisdiction over the type of work 27 performed, nor shall any such requirement for a project labor 28 agreement on a project subject to this Act be deemed contrary 29 to the requirement that a bid be let to the lowest 30 responsible bidder.
