Provides that fraternal organizations and veterans' organizations that conduct games under the Act shall not have a single prize that exceeds $500 (now $250). Provides that such organizations shall have no more than 6,000 tickets in a game (now 4,000). Provides that the price for a right to participate in a game conducted by such an organization shall not exceed $2 (now $1). Provides that the value of all prizes awarded in a single day by such an organization shall not exceed $5,000 (now $2,250). LRB9003284LDpk HB1840 Enrolled LRB9003284LDpk 1 AN ACT to amend the Illinois Pull Tabs and Jar Games Act 2 by changing Sections 1.1 and 4. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pull Tabs and Jar Games Act is 6 amended by changing Sections 1.1 and 4 as follows: 7 (230 ILCS 20/1.1) (from Ch. 120, par. 1051.1) 8 Sec. 1.1. Definitions. As used in this Act: 9 "Pull tabs" and "jar games" means a game using 10 single-folded or banded tickets or a card, the face of which 11 is initially covered or otherwise hidden from view in order 12 to conceal a number, symbol or set of symbols, some of which 13 are winners. Players with winning tickets receive a prize 14 stated on a promotional display or "flare". Pull tabs also 15 means a game in which prizes are won by pulling a tab from a 16 board thereby revealing a number which corresponds to the 17 number for a given prize. 18 Each winning pull tab or slip shall be predetermined.In19no instance shallThe right to participate in such games 20 shall not cost more than $2. Noone dollar, nor shall any21 single prize shall exceed $500$250. There shall be no more 22 than 6,0004000tickets in a game. 23 "Pull tabs and jar games", as used in this Act, does not 24 include the following: numbers, policy, bolita or similar 25 games, dice, slot machines, bookmaking and wagering pools 26 with respect to a sporting event, or that game commonly known 27 as punch boards, or any other game or activity not expressly 28 defined in this Section. 29 "Organization" means a corporation, agency, partnership, 30 association, firm or other entity consisting of 2 or more 31 persons joined by a common interest or purpose. HB1840 Enrolled -2- LRB9003284LDpk 1 "Non-profit organization" means an organization or 2 institution organized and conducted on a not-for-profit basis 3 with no personal profit inuring to anyone as a result of the 4 operation. 5 "Charitable organization" means an organization or 6 institution organized and operated to benefit an indefinite 7 number of the public. 8 "Educational organization" means an organization or 9 institution organized and operated to provide systematic 10 instruction in useful branches of learning by methods common 11 to schools and institutions of learning which compare 12 favorably in their scope and intensity with the course of 13 study presented in tax-supported schools. 14 "Religious organization" means any church, congregation, 15 society, or organization founded for the purpose of religious 16 worship. 17 "Fraternal organization" means an organization of 18 persons, including but not limited to ethnic organizations, 19 having a common interest, organized and operated exclusively 20 to promote the welfare of its members and to benefit the 21 general public on a continuing and consistent basis. 22 "Veterans' organization" means an organization comprised 23 of members of which substantially all are individuals who are 24 veterans or spouses, widows, or widowers of veterans, the 25 primary purpose of which is to promote the welfare of its 26 members and to provide assistance to the general public in 27 such a way as to confer a public benefit. 28 "Labor organization" means an organization composed of 29 labor unions or workers organized with the objective of 30 betterment of the conditions of those engaged in such pursuit 31 and the development of a higher degree of efficiency in their 32 respective occupations. 33 "Youth athletic organization" means an organization 34 having as its exclusive purpose the promotion and provision HB1840 Enrolled -3- LRB9003284LDpk 1 of athletic activities for youth aged 18 and under. 2 "Senior citizens organization" means an organization or 3 association comprised of members of which substantially all 4 are individuals who are senior citizens, as defined in the 5 Illinois Act on the Aging, the primary purpose of which is to 6 promote the welfare of its members. 7 (Source: P.A. 85-1012.) 8 (230 ILCS 20/4) (from Ch. 120, par. 1054) 9 Sec. 4. The conducting of pull tabs and jar games is 10 subject to the following restrictions: 11 (1) The entire net proceeds of any pull tabs or jar 12 games, except as otherwise approved in this Act, must be 13 exclusively devoted to the lawful purposes of the 14 organization permitted to conduct such drawings. 15 (2) No person except a bona fide member or employee of 16 the sponsoring organization may participate in the management 17 or operation of such pull tabs or jar games; however, nothing 18 herein shall conflict with pull tabs and jar games conducted 19 under the provisions of the Charitable Games Act. 20 (3) No person may receive any remuneration or profit for 21 participating in the management or operation of such pull 22 tabs or jar games; however, nothing herein shall conflict 23 with pull tabs and jar games conducted under the provisions 24 of the Charitable Games Act. 25 (4) The price paid for a single chance or right to 26 participate in a game licensed under this Act shall not 27 exceed $2$1. The aggregate value of all prizes or 28 merchandise awarded in any single day of pull tabs and jar 29 games shall not exceed $2,250, except that in adjoining 30 counties having 200,000 to 275,000 inhabitants each, and in 31 counties which are adjacent to either of such adjoining 32 counties and are adjacent to total of not more than 2 33 counties in this State, the value of all prizes or HB1840 Enrolled -4- LRB9003284LDpk 1 merchandise awarded may not exceed $5,000$3,250in a single 2 day. 3 (5) No person under the age of 18 years shall play or 4 participate in games under this Act. A person under the age 5 of 18 years may be within the area where pull tabs and jar 6 games are being conducted only when accompanied by his parent 7 or guardian. 8 (6) Pull tabs and jar games shall be conducted only on 9 premises owned or occupied by licensed organizations and used 10 by its members for general activities, or on premises owned 11 or rented for conducting the game of bingo, or as permitted 12 in subsection (4) of Section 3. 13 (Source: P.A. 86-289.)
