LRB9001646JSgc LRB9001646JSgc 1 AN ACT to amend the Public Utilities Act by changing 2 Section 4-201. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Utilities Act is amended by 6 changing Section 4-201 as follows: 7 (220 ILCS 5/4-201) (from Ch. 111 2/3, par. 4-201) 8 Sec. 4-201. Enforcement of laws; electronic trespass. It 9 is hereby made the duty of the Commission to see that the 10 provisions of the Constitution and statutes of this State 11 affecting public utilities, the enforcement of which is not 12 specifically vested in some other officer or tribunal, are 13 enforced and obeyed, and that violations thereof are promptly 14 prosecuted and penalties due the State therefor recovered and 15 collected, and to this end it may sue in the name of the 16 People of the State. 17 It shall be the duty of the Commission, at the direction 18 and discretion of the Chairman, to assemble and maintain an 19 electronic trespass enforcement assistance staff consisting 20 of experts in computer systems, electronics and other 21 professional disciplines to aid public utilities, businesses, 22 individuals and law enforcement agencies in detecting and 23 preventing electronic trespass violations and enforcing the 24 provisions of Section 16-9 of the "Criminal Code of 1961", 25 approved July 28, 1961, as amended or any other relevant 26 statute. 27 No cause of action shall exist and no liability may be 28 imposed either civil or criminal, against the State, the 29 Chairman of the Commission or any of its members, or any 30 employee of the Commission, for any act or omission by them 31 in the performance of any power or duty authorized by this -2- LRB9001646JSgc 1 Section, unless such act or omission was performed in bad 2 faith and with intent to injure a particular person. 3 (Source: P.A. 84-617.)
