90_HB1757ham001 LRB9004463KDksam 1 AMENDMENT TO HOUSE BILL 1757 2 AMENDMENT NO. . Amend House Bill 1757 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The Illinois Human Resource Investment 5 Council Act is amended by changing Section 3 as follows: 6 (20 ILCS 3975/3) (from Ch. 48, par. 2103) 7 (Text of Section before amendment by P.A. 89-507) 8 Sec. 3. The Council shall consist of members appointed 9 by the Governor with the advice and consent of the Senate in 10 accordance with the requirements of Section 701 of Title VII 11 of the federal Job Training Partnership Act. 12 (a) At least 15% but not more than 60% of the members 13 shall be representatives of business, industry and 14 agriculture, including persons who are representatives of 15 business and industry on Private Industry Councils in the 16 State. 17 (b) The following State officials shall serve on the 18 Council but shall not constitute more than 60% of the 19 Council's membership: the Director of Commerce and Community 20 Affairs (administering agency for the Job Training 21 Partnership Act and the National and Community Service Act), 22 the Director of Public Aid (administering agency for part F -2- LRB9004463KDksam 1 of Title IV of the Social Security Act and the employment 2 program established under Section 6(d)(4) of the Food Stamp 3 Act of 1977), the Director of the Department of Employment 4 Security (administrator of the Wagner-Peyser Act), the State 5 Superintendent of Education (administrator of the Carl D. 6 Perkins Vocational and Applied Technology Education Act and 7 the Adult Education Act), and the Executive Director of the 8 Illinois Community College Board, or their designees. Each 9 member shall serve during the term of his office or 10 employment. 11 (c) At least 15%, but no more than 60% of the members 12 shall be representatives of organized labor. These members 13 shall be selected from among individuals nominated by 14 recognized State labor federations. 15 (d) The Human Resource Investment Council shall include 16 one or more representatives from each of the following: 17 (1) local public education; 18 (2) a postsecondary institution; 19 (3) a secondary or postsecondary vocational 20 education institution;and21 (4) 3 separateacommunity based organizations, 22 which are directly involved in job training or work force 23 development; and 24 (5) each of the 4 caucuses of the General Assembly, 25 chosen by each of the 4 leadersorganization. 26 Representatives from these entities shall constitute no 27 more than 60% of the Council. The total number of 28 representatives appointed under (1), (2), and (3) shall not 29 constitute less than 15% of the membership of the Human 30 Resource Investment Council. 31 (d-5) The Human Resource Investment Council may also 32 include additional qualified members who may be selected from 33 the following, but who shall not constitute more than 60% of 34 the Council: -3- LRB9004463KDksam 1 (1) representatives from local welfare agencies; 2 (2) representatives from units of local government 3 or consortia of units of local government appointed from 4 nominations by the chief elected officials of the units 5 of local government or consortia; 6 (3) representatives from public housing agencies; 7(4) representatives from the State legislature;8 (4)(5)representatives from any State or local 9 program that receives funding under an applicable federal 10 human resource program that the Governor has determined 11 has a direct interest in the utilization of human 12 resources within the State; and 13 (5)(6)individuals who have special knowledge and 14 qualifications in special education and career 15 development needs of hard-to-serve individuals. 16 (e) In reconstructing the membership of the Council 17 pursuant to subsections (a), (b), (c), (d), and (d-5), as 18 mandated in Section 701 of Title VII of the federal Job 19 Training Partnership Act, as amended, appointments made 20 effective on July 1, 1995 will be given fixed and staggered 21 terms of no less than 2 years. Thereafter, members of the 22 Council shall be appointed for terms of two years expiring on 23 July 1, or until their successors are appointed and 24 qualified. The Governor may at any time make appointments to 25 fill vacancies for the balance of an unexpired term. 26 Vacancies shall be filled in the same manner as the original 27 appointment. Members shall serve without compensation, but 28 shall be reimbursed for necessary expenses incurred in the 29 performance of their duties. 30 (f) The Council shall meet at least five times per 31 calendar year at such times and in such places as it deems 32 necessary. The Council shall be subject to the "Open 33 Meetings Act" and, to the extent required by that law, its 34 meetings shall be publicly announced and open and accessible -4- LRB9004463KDksam 1 to the general public. The Council shall adopt such rules 2 and operating procedures as it deems necessary to carry out 3 its responsibilities under this Act and under the federal Job 4 Training Partnership Act. 5 (Source: P.A. 89-382, eff. 8-18-95.) 6 (Text of Section after amendment by P.A. 89-507) 7 Sec. 3.
