LRB9004142MWpc LRB9004142MWpc 1 AN ACT to amend the Freedom of Information Act by 2 changing Section 1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Freedom of Information Act is amended by 6 changing Section 1 as follows: 7 (5 ILCS 140/1) (from Ch. 116, par. 201) 8 Sec. 1. Legislative intent. Pursuant to the fundamental 9 philosophy of the American constitutional form of government, 10 it is declared to be the public policy of the State of 11 Illinois that all persons are entitled to full and complete 12 information regarding the affairs of government and the 13 official acts and policies of those who represent them as 14 public officials and public employees consistent with the 15 terms of this Act. ThatSuchaccess is necessary to enable 16 the people to fulfill their duties of discussing public 17 issues fully and freely, making informed political judgments 18 and monitoring government to ensure that it is being 19 conducted in the public interest. 20 This Act is not intended to be used to violate individual 21 privacy, nor for the purpose of furthering a commercial 22 enterprise, or to disrupt the duly-undertaken work of any 23 public body independent of the fulfillment of any of the 24 fore-mentioned rights of the people to access to information. 25 This Act is not intended to create an obligation on the 26 part of any public body to maintain or prepare any public 27 record which was not maintained or prepared by such public 28 body at the time when this Act becomes effective, except as 29 otherwise required by applicable local, State or federal law. 30 These restraints on information access should be seen as 31 limited exceptions to the general rule that the people have a -2- LRB9004142MWpc 1 right to know the decisions, policies, procedures, rules, 2 standards, and other aspects of government activity that 3 affect the conduct of government and the lives of any or all 4 of the people. The provisions of this Act shall be construed 5 to this end. 6 This Act shall be the exclusive State statute on freedom 7 of information, except to the extent that other State 8 statutes might create additional restrictions on disclosure 9 of information or other laws in Illinois might create 10 additional obligations for disclosure of information to the 11 public. 12 (Source: P.A. 83-1013.)
