LRB9004368JSfg LRB9004368JSfg 1 AN ACT to amend the Public Utilities Act by changing 2 Section 5-102. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Utilities Act is amended by 6 changing Section 5-102 as follows: 7 (220 ILCS 5/5-102) (from Ch. 111 2/3, par. 5-102) 8 Sec. 5-102. Uniform system of accounts. The Commission 9 mayshall have power toestablish a uniform system of 10 accounts to be kept by public utilities ortoclassify public 11 utilities andtoestablish a uniform system of accounts for 12 each class andtoprescribe the manner in which such accounts 13 shall be kept. It may also, in its discretion, prescribe the 14 forms of accounts to be kept by public utilities, including 15 records of service, as well as accounts of earnings and 16 expenses, and any other forms, records and memoranda which, 17 in the judgment of the Commission may be necessary to carry 18 out any of the provisions of this Act. The system of 19 accounts established by the Commission and the forms of 20 accounts prescribed by it shall not be inconsistent, in the 21 case of corporations subject to the provisions of the Act of 22 Congress entitled, "An Act to regulate commerce," approved 23 February fourth, eighteen hundred and eighty-seven, and the 24 Acts amendatory thereof and supplementary thereto, with the 25 systems and forms from time to time established for those 26suchcorporations by the Interstate Commerce Commission, but 27 nothing herein contained shall affect the power of the 28 Commission to prescribe forms of accounts for thosesuch29 corporations, with the approval of the Interstate Commerce 30 Commission, covering information in addition to that required 31 by the Interstate Commerce Commission. Where the Commission -2- LRB9004368JSfg 1 has prescribed the forms of accounts to be kept by any public 2 utility for any of its business, it shall thereafter be 3 unlawful for such public utility to keep any accounts for 4 such business other than those prescribed or approved by the 5 Commission, or those prescribed by or under the authority of 6 any other state or of the United States. 7 The Commission may, from time to time, alter, amend or 8 repeal, in whole or in part, any uniform system of accounts, 9 or the form and manner of keeping accounts. 10 (Source: P.A. 84-617.)
